Appearance was also made by <br />Mr, and Mrs. Paul Pojar, Mr. and Mrs, Eugene Talbot and Mr, Norman Holt, RSr. Talbot <br />explained that he did not porsonally want to cause any hardship to Mrs, Gruber and <br />he thought that perhaps the use restrictions as written would permit the subdividing <br />of Grubers' lot. RSr., Memmer, attorney for the Village, advised the Council that in <br />view of all of the facts, the Counci5. should refrain from granting any authority to <br />divide the proporty. He stated that the burden of proving that this property could <br />be divided should a°est on R4rs. Gruber anal that the Village Council should do nothing <br />at this time to place itself in the position of having violated the spirit and intent <br />of the use restrictions. <br />Upon motion by Nadeau, seconded by Spooner, i.t was <br />°RESOLVED, That the request o£ Mrs, Gruber for a building <br />permit on the North half of Tract E., being the parcel consist- <br />ing of slightly more than one acre located on the Northwest <br />cornez• of County Road li, and RSchfenemy Road, be and is hereby <br />denied." <br />Ayes - 5 Nays - 0 <br />The resolution was adopted. <br />RSr. Richard Fenstermaker appeared before the Council and stated that he <br />was interested i.n what had been done about vacating Eighth Street, The Clerk explained <br />that the Council had conducted a hearing and that there were no objections so that <br />vacation had been approved. <br />Upon motion by Vitale, seconded by Loeffler, it was <br />`~I2ESOLVED, That the hearing with reference to the closing <br />of Eighth Street be and is hereby reopened and that Mr. Fenster- <br />maker be affoa•ded an oppox•tunii:y to state his position to the <br />Council.." <br />Ages -- 5 Nays - 0 <br />The resolution was adopted and tlxe hearing reopened. <br />RSr. Fenstermaker then stated that while he was not opposed to vaoat:ing the <br />street, he did feel that if the street were vacated, that part of the portion dedicated <br />for street use should accrue to him. After some discussion Mr. Fenstermaker formally <br />stated that he opposed the vacating of the street, No other persons made any repre- <br />sentations in opposition to the vacation. <br />Upon motion by Spooner, seconded by Loeffler, it was <br />"RESOLVED, That Eighth Street be vacated as decided earlier <br />in the meeting," <br />Ayes - d John Vita3.e voted Nay <br />The resolution vras adopted. <br />Oscar Londin, Building Inspector, informed tlxe Council as to the condition <br />of the buildi.rxgs on the Costello property.
