Regular IJteeting - September 10, 1958 <br />"BE 1T FURTHER P.ESOLVED that the elevations and grades as <br />sixown in sa9.d plans and specifications be and they are hereby <br />approved and consent is hereby given to any and all changes in <br />grade occasioned by the construction of said 'Prunlc Highway Number <br />390 renumbered as Trunk Highway Number 35 in accordance with said <br />plans and specifications." <br />Ayes - 4 Nays - 0 <br />The resolution was adopted. <br />Upon motion by Nadeau, seconded by Loeffler, the following resolution <br />was submitted: <br />"WHEREAS the Commissioner oP Highways has approved the plans <br />and specifications for the improvement of that part of Trunk <br />Highway Number 390 renumbered as Trunic Highway Number 35 within <br />the corporate limits of the V117.a~e of Little Canada from 0.1 miles <br />South of County Road No. 63 to Nortlx Corporate Limits; and <br />°iNHEREAS in order to obtain Federal aid in the construction of. <br />said Trwxk Highway Number 390 renumbered as Trunk Highway Number <br />35 the Bureau of Public Roads requies the assurance that the <br />Village of Little Canada will not suffer any encroachment of: <br />any Icitxd or nature whatsoever on the right-of-way of said Trunk <br />highway Number 390 renumbered as Trunic Highway Number 35 ithin <br />the corporate limits of the said Village of Little Canada; and <br />"WHEREAS the Commissioner of Highways desires in the interest. <br />of public safety that all parking o.f vehicles on said trunk highway <br />be parallel with the curb and at least 20 Peet from any crosswalk. <br />"NOVd, THEN, BE IT RESOLVED that said Village oP Little Canada <br />does hereby agree and covenant that it will never pes•mit or supper, <br />within Its corporate limits, any encorachment of any kind whatsoever, <br />including curb gas pumps and gas stations, billboards or other <br />structures of any Icitxd whatsoever, upon the right oP way of Trunk <br />Highway Number 390 renumbered as Trunk Highway Number 35 and to <br />the above end said Village of Little Canada hereby agrees that it <br />will never issue any license, pexmtit, or grant, or give any leave <br />or liberty or any other consent of whatever form for the construc- <br />tion or maintenance of any encroachment whatsoever, including curb <br />gas pumps and gas stations, billboards or other structures of any <br />hind whatsoever, upon said right of way; and that said Village of <br />Little Canada will cooperate insofar as possible to eliminate <br />existing encroachments constituting traffic hazards and will further <br />take any necessary action to eliminate any encroachment that may <br />hereafter exist on said trunk highway right of way; and <br />"BE lT FURTHER RESOLVED that said Village of Little Canada does <br />hereby agree to require the pax•ki.ng of all vehicles ou said trxtnlc <br />highway to be parallel with the curb and ai; least 9;wenty (20) feet <br />Prom any crosswalks on all public streets intersecting said trunk <br />highway within the corporate limits of said Village of Little Canada." <br />Ayes - 4 Nays - 0 <br />'rhe resolu5a on was adopted. <br />S - <br />
