MINUTES <br />CITY COUNCIL <br />AUGUST 13, 2008 <br />Blesener stated that he supported the recommendation of the City <br />Engineer and the Public Works Superintendent relative to the Kohlman <br />Lane sanitary sewer line as outlined in the City Engineer's letter dated <br />August 13, 2008. The Council agreed. The Adminisriator stated he will <br />attempt to obtain a written agreement to this effect. <br />CLOSED Based on the recommendation of the City Attorney, Council convened <br />SESSION into closed session at 8:11 p.m. to discuss pending litigation relative to <br />Twin Cities Stores-Oasis and Dayspring Development. <br />Mr. Montour inri•oduced the following resolution and moved its adoption: <br />RESOLUTTON NO. 2008-8-I94 - TEMPORARILYADJOURNING <br />THE REGULAR COUNCIL MEETING AND CONVENING INTO <br />CLOSED SESSION AS RECOMMENDED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-8-I95 -ADJOURNING THE CLOSED <br />COUNCIL MEETING AND RECONVENING THE REGULAR <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The regular Council meeting was reconvened at 8:46 p.m. <br />PENDING Pete Regnier, Jardine, Logan, representing the City in the pending <br />LITIGATION - litigation relative to Twin Cities Stores-Oasis as well as Dayspring <br />OASIS AND Development, reported that a proposed Settlement Agreement has been <br />DAYSPRING worked out between the City of Little Canada, Twin Cities Stores, and <br />DEVELOPMENT Minnesota Petroleum, and it was his recommendation to the City Council <br /> that the Settlement Agreement be accepted. Regnier noted that in <br /> accepting the Settlement Agreement, the lawsuit will go away at no cost to <br /> the City. The remediation escrow funds will be released. At the time that <br /> the former Oasis property is developed, should the PCA determine that <br /> additional remediation is necessary, the City retains its rights to pursue <br /> remediation costs from Twin Cities Stores. <br />
