11. Waste or recyclable material shall be contained in a refuse container. All <br />such containers shall be stored within a screened enclosure within the rear <br />yard of the property. Waste handling equipment is not shown on the site <br />plan - if indoors, it would meet tke requirements of this section. <br />12. The storage area shall be paved with asphalt, concrete, or other material <br />approved by the City Council. The storage area is listed being paved <br />witk asphalt surface, consistent with this requirement. <br />13. The storage area shall not occupy any space required for conformity to the <br />parking regulations of the Zoning Ordinance. The applicant proposes five <br />spaces in tl:e front area on a paved and curbed driveway, based on a low <br />employee count on the property. The parking requirement for this <br />building as a combination of offzce and shop space would be 12 spaces. <br />The site plan should be revised fo show where an additional seven <br />parking spaces could be provided as "proof of parking" if they were <br />defermined to be necessary in the future. <br />14. The property, including buildings and exterior site areas, shall comply <br />with all applicable fire codes. Tl:e fire chief s/zould comment on <br />compliance with this regulation. <br />15. All lighting shall be hooded and so directed that the light source shall not <br />be visible from the public right-of--way or from neighboring residential <br />uses, and shall be in compliance with Section 903.020.I of the Zoning <br />Ordinance. T/ze site plan does not detail the layout of the site lighting, <br />although the applicant provides a verbal description of lighting as being <br />hooded. Amore complete site plan description of this requirement shall <br />be a condition of approval. <br />16. All other provisions and requirements as deemed necessary by the City <br />Council. <br />17. The applicant complies with the provisions of Section 921 of the Zoning <br />Ordinance. <br />Variances. <br />Variances are to be reviewed based on the Zoning Ordinance requirements that a <br />specific, unique condition of the property is identified that creates anon-economic <br />hardship in putting the property to reasonable use. The applicant is seeking two <br />variances, one for height (to allow RV's to be stored outside, exceeding the 8 foot <br />storage height limitation), and another to avoid installing additional landscaping in front <br />of the screening fences. <br />With regard to the height of storage, the City adopted the current ordinance, in part, to <br />ensure that while outdoor storage was allowed in the I-1 District, it would allowed in a <br />such a way that it would have the least visual impact possible. An exception was <br />written in for construction equipment, acknowledging that many current businesses in <br />the park would need this type of exception to continue operation, and that most <br />construction equipment was not able to be stored indoors. It would not appear this type <br />of exception would apply to Recreational Vehicles, for which garages, or garage <br />entrances, can be constructed to accommodate their indoor storage. For the subject <br />property, it is clear that indoor service work on such vehicles would require this type of <br />access.
