921. ADMINISTRATION -AMENDMENTS (INCLUDING REZONINGS) <br />INTERIM USE PERMITS, AND CONDITIONAL USE PERMITS <br />921.010. PROCEDURE. <br />A. The word amendment shall refer to Zoning Ordinance text amendments, and Zoning <br />District Boundary amendments (rezonings) to the Official Zoning Map. Requests for <br />amendments or conditional use permits, as provided within this Ordinance, shall be filed <br />with the Zoning Administrator on an official application form. Such application shall be <br />accompanied by a fee as provided for ordinance. This fee shall not be refunded. Such <br />application shall also be accompanied by five (5) full=s'ized~cotaies and one (1)~reduce~ <br />digitiTfile copy of detailed written and graphic materials fully explaining the proposed <br />change, development, or use and a mailing list of owners of property located within three <br />hundred fifty (350) feet of the subject property accompanied by an abstractor's certificate <br />when such list: is not accessible to}City stafE.* The request for amendment or conditional <br />use permit shall be placed on the agenda of the first possible Planning Commission <br />meeting occurring after seventeen (17) days from the date of submission. The request <br />shall be considered as being officially submitted when all the information requirements <br />are complied with. <br />*Note: When the properties surrounding the subject property include townhouse or <br />condominium development, the applicant may submit a mailing list of property <br />owners obtained from the managers or homeowners association of the townhouse <br />or condominium development. <br />B. The Zoning Administrator shall instruct the appropriate staff persons to prepare technical <br />reports where appropriate, and provide general assistance in preparing a recommendation <br />on the action to the City Planting Comtttission and City Council. Additionally, the <br />Zoning Administrator shall refer the application to other local, state and special unit <br />governments where appropriate and when required. <br />C. The Planning Commission shall consider possible adverse affects to the proposed <br />amendment or conditional use. Its judgment shall be based upon (but not limited to) the <br />following factors: <br />The applicant shall demonstrate by clear and convincing evidence that the <br />proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the <br />area. <br />Little Canada Zoning Ordinance Administration -Amendments <br />921-1 <br />
