<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Heidi Heller, City Clerk <br /> <br />DATE: September 25, 2019 <br /> <br />RE: Public Hearing: Interim Use Permit to Allow a Temporary Classroom at 3205 <br />Country Drive <br /> <br />BACKGROUND <br />On September 12, 2019, the Planning Commission considered the request by the Finishing Trades <br />Institute of the Upper Midwest (FTIUM) to locate a temporary classroom trailer on the property <br />at 3205 Country Drive for up to 3 years. The FTIUM leases space in the building owned by IUPAT <br />District Council 82 (the Painters & Allied Trades Union), and provides the training and <br />certifications for professional tradespeople. Their programs have become more popular since they <br />became a fully accredited community college five years ago. FTIUM staff are working with the <br />building owner to evaluate their training space needs and what the building can accommodate, but <br />they need more space soon, and the temporary classroom would give them time to determine what <br />their space needs are and potentially complete a remodeling project in the building. <br /> <br />The FTIUM proposed two options for where to locate the classroom trailer, both in the rear of the <br />property. After the Planning Commission discussed the options, and heard from an adjacent <br />business owner, they unanimously recommend approval of an Interim Use Permit to allow a <br />temporary classroom trailer for up to 3 years at 3205 Country Drive, subject to the following <br />conditions: <br /> <br />• The facility is in place for no more than 3 years from date of City Council Approval; <br />• The Building Official certifies that the facility is suitable for occupancy as proposed; <br />• The facility is operated during daytime hours from Monday to Friday only; <br />• The applicant executes an agreement specifying the terms of the Interim Use Permit, <br />the discontinuation of the temporary building and use, and complies with any financial <br />security required by the City Council, and as recommended by the City Attorney; <br />• And any comments and recommendations of other staff and the Planning Commission. <br />• If Option 2 is chosen, then the opposing parking spaces to the east may not be used <br />during this interim period, and the drive aisle must be kept at least 24 feet wide. <br /> <br />The regular process after a planning case is complete, is for Staff to send a planning case <br />notification form to the applicant, which officially notifies them of the City Council action and <br />any conditions that were included with the approval. If Council approves an interim use permit <br />for FTIUM, staff will draft this form with the Council action and conditions and require that it <br />be signed by the applicant, so that they are acknowledging and agreeing to the conditions of the
