1 <br /> <br />the approved site plans, and an amendment to the PUD is required when substantive <br />changes to the site plans are proposed. In this case, since the change is temporary <br />only, the City can consider the classroom under an interim use permit as a part of the <br />existing PUD. <br /> <br />Analysis <br /> <br />Process. An Interim Use Permit is essentially a Conditional Use with a time limit. The <br />standards for Interim Use Permit review, generally, can be summarized as to whether <br />the proposed temporary use will be consistent with the overall principal use of the <br />property, and with the intent of the zoning ordinance for the site. For interim uses, it is <br />important to know how the use will function within the longer term objectives for the <br />property, and to ensure that the interim use will not interfere with those objectives. <br /> <br />Review. In this case, the issues raised by the temporary classroom include departures <br />from the common ordinance standards in two areas: <br /> <br />(1) The use of a temporary building, rather than a permanent addition to the <br />property, is not commonly permitted. Improvements to property are typically <br />expected to be permanent. <br /> <br />(2) The second area would be parking supply. The proposed classroom would <br />occupy several existing parking spaces that were required as a part of the <br />original PUD approval. <br /> <br />As noted, the applicants propose to install the building for temporary use, for a period of <br />up to three years. They indicated that the building will be approximately 31 feet wide <br />(including the access stairs) by 68 feet deep. A total of up to 40 students will occupy <br />the building, which is divided into 2 classroom areas. <br /> <br />Temporary Buildings. While the building would not be expected to be commonly <br />allowed in a PUD zoning district, the proposed two alternative locations would not <br />appear to raise issues for the function or appearance of the PUD development. <br />The locations proposed are both near the rear of the primary building, and would <br />have limited visibility from the primary street (Country Drive). <br /> <br />Visibility and aesthetics are one of the primary values of this particular PUD. As <br />the proposed building should not negatively impact the visual aspects of the <br />project, and particularly since the period is expected to be for only a short term, <br />the proposed amendment can be considered consistent with the original PUD <br />intent. <br /> <br />The primary issue related to temporary buildings can be the “temporary” aspect, <br />and how the City can be assured that the building is removed in a timely manner. <br />In this regard, any amendment to the PUD would specify the time limit as a <br />central aspect of the Interim Use Permit. <br />
