Some statutes require that notice be published for a certain number of <br />“successive weeks.” In such a case, the term “weeks” means calendar <br />weeks. The publication may occur on any day of each successive week, <br />but at least five days must elapse between each publication. At least the <br />number of weeks specified in “successive weeks” must elapse between the <br />first publication and the day of the event for which the publication is <br />made. <br />Minn. Stat. § 331A.09. Any public notice may be printed in a newspaper published on a Sunday <br />or a holiday. Likewise, notice may be published on any day in each week <br />of the term for any notice that is required to be published for any given <br />number of weeks. If notice is published as many weeks and as many times <br />in each week as required by law, it is a lawful publication. <br /> F. Affidavits of publication <br />Minn. Stat. § 331A.07. A newspaper cannot recover compensation for publishing a public notice <br />unless the bill is accompanied by an affidavit of the publisher or the <br />publisher’s designee. The affidavit must include the following <br />information: <br /> • The fact that the newspaper has complied with all the requirements to <br />constitute a qualified newspaper. <br />• The dates (month, day of week, year) that the public notice was <br />published. <br />• The lowest classified rate paid by commercial users for comparable <br />space. <br /> Cities should make sure they receive such an affidavit before paying any <br />bill from a newspaper that has published any public notice for the city. <br /> G. Fees for publication <br />Minn. Stat. § 331A.06, subd. <br />1. The maximum rate charged for publication of a public notice must not <br />exceed the lowest classified rate paid by commercial users for comparable <br />space in the newspapers in which the public notice appears. The rate must <br />include all cash discounts, multiple insertion discounts, and similar <br />benefits extended to the newspaper’s regular customers. <br />Minn. Stat. § 331A.06, subd. <br />2. No newspaper may increase its rates for publishing public notices by more <br />than 10 percent per year as compared to the maximum rate actually <br />charged by the newspaper in the previous year for such notice. An annual <br />rate increase is not required.
