<br />5 <br /> <br />11. Owner hereby grants City, its agents and employees, a license to enter any of the Property <br />to perform all necessary work, maintenance and/or inspections deemed appropriate by the City during <br />operation and associated with the restoration of the Property. The license shall expire after the cessation <br />of activities pursuant to the Interim Use Agreement. <br />12. The Owner remains responsible for the environmental condition of the Property. <br /> <br />The City shall not have any responsibility or obligation to undertake any clean-up or remediation <br />for environmental pollution on the Property. <br />ADDITIONAL DOCUMENTS <br /> <br />13. Prior to the execution of this Agreement, Owner has submitted, and the City has <br />approved, design drawings and schematic plans. The items referenced, whether submitted with <br />Owner's 2019 application or in previously submitted and approved in connection with prior <br />agreements with the City, are hereby incorporated by reference in this Agreement. Owner shall <br />act in conformity with those plans and specifications unless deviations are specifically approved <br />by the City Council. <br />PERMITTED ACTIVITY <br /> <br />14. Subject to compliance with the terms of this Agreement, the Owner shall be permitted <br />to operate storage, stockpiling, and processing (crushing) of aggregate materials and other <br />activities relating to the same for the purpose of making recycled concrete and asphalt aggregate, <br />as well as the storage, stockpiling and processing of topsoil (black dirt), as an interim use in an 1 - <br />2 District. <br />15. The site shall be improved and maintained per the approved Site Development Plan <br />on file with the City, which shall include but not be limited to the Owner making improvements <br />to the existing structures at 3101 and 3107 Country Drive, paving the roadway access area, paving
