MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 2008 <br />some history, reporting that Valor Enterprises began operating in the City <br />in early 2000 until their license was revoked in September, 2006. Peterson <br />reported that during that period, from time to time, when issues arose with <br />Valor's Conditional Use Permit and license renewals, these issues were <br />worked out with the Council. Peterson stated that something changed in <br />April of 2006, and it appeared from the Council's meeting minutes that <br />this is when the City became interested in purchasing the Valor property. <br />Peterson stated that there was no way to resolve Valor's issues, and the <br />revocation of the CUP and licenses occurred in September of 2006. <br />Peterson stated that their attempts to get the City to reissue the CUP and <br />license failed even through Valor felt they met all qualifications. <br />Peterson pointed out that about this same time, the City put a moratorium <br />in place which made it impossible to do anything with their property, let <br />alone sell it. <br />Peterson reported that Valor Enterprises had come to the decision that <br />their only choice was to sell the property for fair market value and move <br />their business somewhere else. In June of 2007, Valor had a purchase <br />agreement in place. Peterson reported that the Code Enforcement Officer <br />and the City Administrator visited the buyers of the property and <br />discouraged them from purchasing the property. Peterson felt there was <br />direct interference with their sale of the property. Peterson reported that <br />over the course of the property listing, there were several other interested <br />parties. City staff would tell these interested parties that the property was <br />contaminated and they should avoid it. <br />Peterson reported that in July of 2007, the City entered into a purchase <br />agreement for this property under the same terms as the previous purchase <br />agreement. In August of 2007, the City withdrew the purchase agreement <br />based on soil conditions since the construction of a public works garage on <br />the property would be slightly more expensive. Peterson stated that the <br />City made repeated comments on its sell-based knowledge of soil <br />conditions in the area, therefore, the soils report should not have been a <br />surprise. <br />Peterson reported that this has been very difficult for her and her family <br />and her finances. The damages they have suffered and the costs have <br />prevented them from moving on. Peterson stated that Valor Enterprises <br />wants to sell the property. Peterson stated that if the City's goal was to get <br />Valor Enterprises out of Little Canada, it has achieved that goal. <br />Peterson stated that they want fair market value for their property which is <br />$640,000 as documented by the two purchase agreements they have had, <br />one with the bus company and the other with the City.
