Employees must continue to use paid leave time as appropriate. <br />Employees participating in Workflex will continue to receive the same number of holiday <br />hours. Workflex arrangements should not result in additional overtime liability during a <br />holiday week except in extenuating circumstances as authorized by the City Administrator. <br /> <br />B. Special Circumstances <br />Employees may be required to periodically revert to the normal workday schedule (5 days <br />a week) and location (in office) in order to ensure department or division coverage during <br />periods of extended vacation or sick leave, or other circumstances as deemed appropriate <br />by the employee’s supervisor or department head. <br /> <br />Liability <br /> <br />The following criteria regarding Liability and Data Privacy/Security will be considered when <br />making flexible workplace arrangements: <br /> <br />A. The City of Little Canada shall have no liability to third parties for injuries or property <br />damage occurring at the employee’s home. The employee will remain responsible for <br />such injuries and damages and should consult with their Homeowner’s or Renter’s <br />insurance agent to protect themselves. <br /> <br />B. Employees are responsible for submitting claims for stolen or damaged City-owned <br />equipment to their Homeowner’s or Renter’s insurance company and for filing a police <br />report with their local police department. The employee’s supervisor and Metro-Inet <br />should be consulted in the event of any damage to or loss of City property. <br /> <br />C. In accordance with the Occupational Safety and Health Administration (OSHA) Home <br />Worksite Directive (CPL 2-0.125), OSHA will not hold employers liable for <br />employees’ home offices, and does not expect the employer (City of Little Canada) to <br />inspect the home office of their employees. <br /> <br />D. The City has the right to visit the site area to determine if it meets the safety standards; <br />such visit will be scheduled with a minimum 24-hour advance notice. <br /> <br />Data Privacy/Security <br /> <br />The legal status of all data used by the employee remains unchanged by his/her participation <br />in the flexible workplace. <br /> <br />A. Employees will take all necessary precautions to secure and prevent unauthorized <br />access to all data used in the performance of their work responsibilities and agree to <br />follow all pertinent policies, laws and rules regarding data privacy. <br /> <br />B. Documents, reports, data or software products created as a result of work-related <br />activities are the property of the City and are subject to City policies and MN State law. <br />
