101 <br />supervisor or department head. <br /> <br />Liability <br /> <br />The following criteria regarding Liability and Data Privacy/Security will be considered when making <br />flexible workplace arrangements: <br /> <br />A. The City of Little Canada shall have no liability to third parties for injuries or property damage <br />occurring at the employee’s home. The employee will remain responsible for such injuries and <br />damages and should consult with their Homeowner’s or Renter’s insurance agent to protect <br />themselves. <br /> <br />B. Employees are responsible for submitting claims for stolen or damaged City-owned equipment <br />to their Homeowner’s or Renter’s insurance company and for filing a police report with their <br />local police department. The employee’s supervisor and Metro-INET should be consulted in <br />the event of any damage to or loss of City property. <br /> <br />C. In accordance with the Occupational Safety and Health Administration (OSHA) Home <br />Worksite Directive (CPL 2-0.125), OSHA will not hold employers liable for employees’ home <br />offices, and does not expect the employer (City of Little Canada) to inspect the home office of <br />their employees. <br /> <br />D. The City has the right to visit the site area to determine if it meets the safety standards; such <br />visit will be scheduled with a minimum 24-hour advance notice. <br /> <br />Data Privacy/Security <br /> <br />The legal status of all data used by the employee remains unchanged by his/her participation in the <br />flexible workplace. <br />A. Employees will take all necessary precautions to secure and prevent unauthorized access to all <br />data used in the performance of their work responsibilities and agree to follow all pertinent <br />policies, laws and rules regarding data privacy. <br /> <br />B. Documents, reports, data or software products created as a result of work-related activities are <br />the property of the City and are subject to City policies and MN State law. <br /> <br />C. Handling and disposal of documents, reports and data will be in accordance with state and <br />federal law and City of Little Canada policy. <br /> <br />Additional Conditions <br /> <br />A. City employees are ambassadors of the community and should always conduct themselves <br />professionally and uphold organizational values regardless of where the employee is located. <br /> <br />B. Employees working remotely are still held to the same job responsibilities and expected level of <br />service. They are subject to the same terms and conditions of employment and should track and <br />record all hours worked in the same way that they would if they were working in the office.
