Sub-Chapter 16: Application Reviews Conditional Use Permits <br />Page 917-16 <br />application. <br />(C) Thresholds for Application Review <br />If a listed Conditional Use falls below the following threshold, review and approval by the <br />Community Development Director is all that is required before applying for a Building <br />Permit: <br />(1) 500 square feet of floor area for a non-residential building; <br />(2) 120 square feet of floor area for a detached building related to a residence. <br />Review and approval by the City Council shall be required for applications above that <br />threshold or applications involving properties that have not previously received a <br />Conditional Use Permit. <br />(D) Conditions for Approval <br />These conditions must be met: <br />(1) The use is allowed as a Conditional Use in the zoning district and conforms to <br />standard zoning regulations; <br />(2) The Conditional Use will conform to the conditions listed in Chapter 914 for the <br />proposed use; <br />(3) The Conditional Use will not impede the normal and orderly use or development of <br />nearby property, substantially diminish nearby property values or place an undue <br />burden on public facilities or services; <br />(4) The Conditional Use will not be detrimental to the health, safety, or welfare of the <br />public; <br />(5) The Conditional Use will not result in a nuisance by emissions; <br />(6) The Conditional Use will not unduly affect natural features. <br />(E) Additional Conditions <br />In permitting a new Conditional Use or the alteration of an existing Conditional Use, the <br />City Council may impose, in addition to these standards and requirements expressly <br />specified by this ordinance, additional conditions that the Commission considers necessary <br />to protect the best interest of the surrounding area or community as a whole. These <br />conditions may include but are not limited to: <br />(1) Increasing the required lot size or yard dimension. <br />(2) Limiting the height, size or location of buildings. <br />(3) Controlling the location and number of vehicle access points. <br />(4) Increasing the street width. <br />(5) Increasing the number of required off street parking spaces. <br />(6) Limiting the number, size, location or lighting of signs. <br />(7) Requiring additional fencing, screening, landscaping or other facilities to protect <br />adjacent or nearby property. <br />(8) Designating sites for open space. <br />(F) City Staff Review and Recommendation
