<br /> <br /> STAFF REPORT <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: December 11, 2015 <br /> <br />RE: False Alarm Appeal – True Chiropractic <br /> <br />Attached is a letter of appeal submitted by Dr. Jason Wing Louie regarding an invoice he received for false <br />alarms (burglar alarms) totaling $100 (the invoice is also attached). You will note in his letter that he had <br />acquired this building, was doing some remodeling, and experienced difficulties in dealing with the alarm <br />company given the past account holder. <br />Below are the pertinent sections of our Alarm System ordinance (Chapter 816). <br /> 816.020. DEFINITIONS. <br />A. Alarm System. An alarm installation designed to be used for the prevention or detection of <br />burglary, robbery, or fire and located in or on a building, structure or facility. <br />B. Alarm User. The legal entity in control of any building, structure, or facility wherein or <br />whereon an alarm system is located. <br />C. False Alarm. An alarm signal eliciting a response by personnel of the City's law enforcement <br />agency or fire department when a situation requiring a response does not, in fact, exist, and which is <br />caused by the activation of an alarm system through mechanical failure, improper maintenance of the <br />alarm system or the building, structure, or facility, movement, alarm malfunction, improper installation <br />or the inadvertence of the alarm user or its employees, family or agents. A false alarm does not include <br />an alarm caused by climatic conditions such as tornados, thunderstorms, utility line mishaps, violent <br />conditions of nature, or any other conditions which are clearly beyond the control of the alarm <br />manufacturer, installer or user. <br />D. Law Enforcement Agency. An agency or person designated by the City Administrator. <br /> 816.040. USER FEES. <br />(A) An alarm user, whose alarm system has resulted in the reporting of three (3) or more false <br />alarms because of the operation of a burglar alarm, shall be charged user fees as established by City <br />Council resolution. <br />816.060. APPEAL. User fees which have been appealed shall initially be reviewed by the City <br />Administrator or his/her designee. Should the appellant not agree with the decision rendered by the <br />City Administrator, the appeal shall be reviewed by the City Council. The alarm user shall be invited to <br />appear before the City Council. If the alarm user is not present when the Council reviews the appeal, <br />the City Administrator or his/her designee shall notify the alarm user by regular mail, with affidavit of
