User fees, as determined by the City Council, shall be <br />paid within fifteen (15) days of the date of mailing of the City's notice of the Council's decision. <br />Pursuant to the provisions of our ordinance, I made an initial denial of the appeal given the strict reading <br />of our ordinance and suggested he could appeal these charges to the City Council. While I can <br />appreciate the problems experienced as a result of the acquisition of the property and the subsequent <br />remodeling, I do not believe these alarms were beyond the control of the owner/operator. Given the <br />basis of this ordinance is to discourage false alarms and to offset some costs associated with the <br />resources utilized to respond to these types of calls. Furthermore, the alarms do not meet the criteria of <br />those events deemed “not be” false alarms. <br />To the appellant’s credit, he did take actions to rectify the problems. In fact, no further false alarms <br />have occurred at the property since those noted in October. <br />While I do not like to negatively impact any business in the City, especially a new one, I feel <br />consistency in the application of these provisions is needed to treat all property owners fairly.
