2. Illicit Discharges and Connections. Connections to the City's MS4 System must <br />use aCity-approved method. No person shall discharge any material into the municipal <br />storm drain system. Illicit connections to the storm drain system are prohibited <br />regardless of whether the connection was permissible at the time of connection. <br />Suspension of MS4 Access. The City may without notice suspend MS4 discharge <br />access when necessary to stop an actual or threatened discharge presenting <br />imminent and substantial danger to the environment, the health and welfare of <br />persons, or waters of the United States. Illegally discharging may result in <br />termination to MS4 access. The City must notify violators of the proposed <br />termination of access and the violator may petition for reconsideration. <br />Monitoring Discharges. The City must be permitted to enter and inspect such <br />facilities with industrial or construction storm water discharges to determine <br />compliance with this ordinance. Facility operators must allow the city ready <br />access to all parts of the premises for the purposes of inspection. If refused <br />access, the City may seek an administrative search warrant. <br />Use of Best Management Practices. Commercial or industrial establishments <br />must provide, at their own expense, reasonable protection from accidental <br />discharge using best management practices. A property with illicit discharge may <br />be required to implement additional BMP's to prevent further discharge. <br />Watercourse Protection. Every owner of property through which a watercourse <br />passes must keep and maintain the part of the watercourse within their property <br />free of trash, debris, and other obstacles that would pollute or retard the flow of <br />water. The owner or lessee must also maintain structures within or adjacent to a <br />watercourse so as not to impede the watercourse. <br />Notification of Spills. As soon as a person responsible for a facility or operation <br />has information of a known or suspected illegal discharge, they must take all <br />necessary steps to ensure the containment and cleanup of such release. In the <br />event of a hazardous release, they must immediately notify emergency response <br />agencies of the release. In the event of anon-hazardous release, they must notify <br />the City no later than the next business day following discovery of the release. <br />Enforcement. The City may order compliance by written notice to the responsible <br />person and require, at the owner's expense, monitoring, analyses, reporting, the <br />elimination of illicit connections or discharges. The City may also issue cease <br />and desist orders and order the abatement or remediation of stormwater pollution <br />or contamination and the restoration of affected property, and require payment of <br />a fine to cover administrative and remediation costs. The City may order the <br />implementation of source control or treatment BMPs. The City may also seek <br />civil injunctive relief or declare the connection or discharge a public nuisance. <br />
