The City's choice of one enforcement remedy does not prevent the use of other <br />available remedies. <br />A person receiving a notice of violation may appeal. Notice of appeal must be <br />received by the city within five working days from the date of the notice of <br />violation. A hearing on the appeal before the City Council must occur within 15 <br />days from the date of the receipt of the notice of appeal. The City's decision is <br />final. <br />If the violation has not been corrected pursuant to the notice of violation or within <br />3 days of the City's decision on appeal, then the City is authorized to take any and <br />all measures necessary to abate the violation and/or restore the property. <br />The City may assess the costs for abatement by notifying the property owner of <br />the cost within 30 days after abatement of the violation. The property owner then <br />has 10 calendar days to file a written protest to the amount. If the amount is not <br />paid in a timely manner it will become a special assessment against the property <br />and will constitute a lien. <br />EXCEPTIONS. Discharges relating to: water line flushing; landscape irrigation; <br />rising ground water; uncontaminated pumped ground water; foundation or footing <br />drains; crawl space pumps; air conditioning condensation; natural springs; non- <br />commercial washing of vehicles; dechlorinated swimming pools; fire fighting <br />activities; dye testing (with notice to the City); NPDES permitted discharges; and <br />other discharges specified in writing by the City as being necessary to protect <br />public health and safety. <br />3. Good Housekeeping Provisions. Owners and occupants of property within the <br />City may not discharge or otherwise expose any chemical or septic waste in an area <br />where discharge to streets or the storm drain system may occur. Objects containing <br />grease, oil, or other hazardous substances cannot be stored in areas susceptible to runoff. <br />Hazardous wastes must be disposed of properly, and hazardous household waste must not <br />be placed in regular trash containers. Residential water runoff must be minimized. <br />Water runoff from washing paved areas in commercial or industrial property is prohibited <br />unless necessary for health or safety. <br />D. The City must review the stormwater management plan. Plans meeting the requirements <br />of this ordinance entitle the owner to a permit valid for a period of one year authorizing the land <br />disturbance activity. Insufficient plans will be denied, and must be resubmitted and approved <br />before the activity may begin. All land use and building permits on the property must be <br />suspended until the approval of the stormwater plan. <br />E. Modification of Plan. An approved stormwater plan may be modified by submitting and <br />an application for modification to the City. In reviewing the application, the City may require <br />additional reports and data. <br />
