F. Variance Requests. The City may grant a variance on a case-by-case basis and the <br />content of such must be specific. The variance request must be in writing, describe the reason <br />for the request, and follow the procedures listed in Section 922 of the City Ordinances. <br />Economic hardship is insufficient grounds for granting a variance. The City must respond to the <br />variance request in writing and include the justification for granting or denying the request. <br />G. Financial Securities. The applicant must install at their own expense or pay the City's <br />expenses for all stormwater management performance standards necessary to maintain the design <br />criteria specified herein. The City may require the applicant to provide a contribution to the <br />development and maintenance of City stormwater management facilities. <br />H. Inspections and Enforcement. The city will perform inspections during construction. <br />The City may issue stop orders if stormwater management measures are deficient. A second <br />inspection must be passed before any final inspections for occupancy or• approval will be <br />completed. If terms of this ordinance are not met, the City may withhold final approvals, revoke <br />permits, or conduct corrective actions. The City may recover its costs for corrective action. <br />If stormwater management measures malfunction and breach the perimeter of the site, the <br />applicant must immediately develop and implement a cleanup and restoration plan within 48 <br />hours of obtaining right-of--way permission from the adjoining property owner. If, in the <br />discretion of the City, the applicant fails to repair the damage caused, the city may do the work <br />required and charge the cost to the applicant. <br />Any person, firm, or corporation that fails to comply with or violates this ordinance is guilty of a <br />misdemeanor. Each day that a separate violation exists will constitute a separate offense. <br />I. The City requires that stormwater facilities be maintained. All settled materials from <br />ponds, sumps, grit chambers, and other devices, must be removed and properly disposed o£ No <br />private stormwater facilities may be approved without a maintenance plan. All stormwater <br />facilities must be designed to minimise the need for maintenance, provide for easy maintenance <br />access, and be structurally sound. It is the responsibility of the applicant to obtain necessary <br />easements to allow access. The City has the right to inspect all private stormwater facilities <br />during construction and at its discretion after construction is complete. <br />J. Severability.
