MINUTES <br />PLANNING COMMISSION <br />OCTOBER 9, 2008 <br />USE PERMIT - stockpiling and recycling at Fra-Dor, 3137 Country Drive. <br />3137 COUNTRY <br />DRIVE - The City Planner reviewed his report dated October 3, 2008 which <br />FRA-DOR recommends approval of the reissuance of the Interim Use Permit for a <br />period of five years conditioned on the applicant's demonstration that there <br />is another place to move the stockpiling/recycling operation. The Planner <br />reported that Mr. Frattalone has suggested that rather than designation of a <br />relocation site, that he submit a plan for the redevelopment of the property <br />occupied by stockpiling/recycling operation. <br />Knudsen noted the City's desire to see this property redeveloped, and its <br />apparent willingness to offer an extension of the IUP in order for <br />redevelopment to occur. The City Planner agreed that the long-term <br />intension of the City has been for the redevelopment of this property. He <br />noted the history of the creation of the I-2 District relative to this property <br />after the stockpiling/recycling operation had been in place. The IUP for this <br />business was written with the expectation that the stockpiling/recycling <br />operation would close and the property redeveloped. <br />Frattalone presented the Commission with a history of the property <br />beginning in 1980-1982 when he purchased it. He noted that the property <br />was about to go tax-forfeit, and he bought it and put it to use. Frattalone <br />reported that he worked with the State, County, and City and obtained a <br />demolition landfill permit for the property. Frattalone indicated that this <br />site is his second landfill site. The first was at 3036 Spruce Street where he <br />corrected soils and established a building pad and then developed the <br />property. <br />Frattalone indicated that he had a small stockpiling/recycling operation at <br />3066 Spruce Street. He would bring surplus materials in and when there <br />was enough, he would crush and sell the product. There were some <br />complaints about the dust, etc., and Frattalone reported that the City asked <br />that he move the operation to the landfill site, cun•ently the Fra-Dor site. <br />Frattalone again indicated that the crushing operation was apart-time <br />business with crushing happening about once per year. There was dust and <br />consequently complaints. Frattalone indicated that he worked with the <br />Council to try to address the issues. This did not go well, and the Council <br />passed an ordinance banning the recycling operation and giving him a <br />couple of years to move it. The Council then granted an extension, and <br />Frattalone reported that he built a building on the property, put in benning <br />and landscaping, and worked at dust control. Frattalone also reported that <br />he has been working with the City over the years toward the redevelopment <br />of the property. He pointed out that he put in sewer and a lift station. He <br />noted that the City was going to bring sewer and water into the area, but this <br />has not yet happened. Frattalone indicated that the Fra-Dor site is the only <br />one connected to the sewer at this time. <br />-11- <br />
