Sandberg felt that <br />would be disastrous at this time as they would not be able to rent the space. <br />Knudsen asked if the Commission needed to act on the appeal relative to the <br />salvage license. The City Planner reported that the appeal is related to City <br />staff's determination that there is no active salvage operation. The City <br />Council will make a final determination on that issue. The Planner noted <br />that should the Council determine that the salvage yard has been active, the <br />salvage yard is grandfathered in. He noted that a grandfathered use would <br />be allowed to continue in its same manner and size; it could not be <br />expanded. <br />Knudsen noted the previous comments relative to R & S working on their <br />tenants' vehicles and equipment. Pechmann stated that he was <br />uncomfortable with using that mechanism to allow this outdoor storage to <br />remain. Pechmann suggested the option of R & S buying an equity position <br />in their tenants' businesses as a means of allowing them to remain. The <br />City Planner was not sure this was a viable option noting that the ordinance <br />is based on use and not ownership. <br />Knudsen again stated that he was willing to support the position that Figg <br />was grandfathered in. He noted that it is the Commission's job to look at <br />the proposal from a planning perspective. <br />Duray again noted that R & S would have to option to lease off-site outdoor <br />storage space to other I-1 Little Canada businesses by IUP. The Planner <br />replied that that was correct. The Planner suggested that the Commission <br />could recommend approval of Interim Use Permits for the R & S property <br />subject to compliance with Code requirements. R & S would then have 12 <br />months within which to find appropriate off site storage tenants. The City <br />would have review of the individual tenants as part of the outdoor storage <br />licensing process. The Planner noted that if the IUP application is denied <br />and R & S finds an appropriate tenant, they would have to reapply and starC <br />the process over. <br />Jeff Helmeke asked if the current outdoor storage tenants would have 12 <br />months to vacate the property. The City Planner indicated that the <br />Commission could recommend a time period for these tenants to vacate, but <br />he would recommend something less than 12 months given these are <br />illegally established uses. Duray stated that he would be inclined to give <br />these tenants 12 months to vacate, thus giving R & S 12 months to find new <br />tenants. Knudsen felt that 6 months was a more reasonable time period for• <br />the tenants to vacate. <br />Knudsen asked about Figg Masonry. The City Planner indicated that the <br />City could make an allowance for Figg Masonry as being grandfathered in. <br />-8- <br />
