MINUTES <br />PLANNING COMMISSION <br />OCTOBER 9, 2008 <br />Figg would not have to comply with current ordinance requirements, but <br />would be grandfathered in as they currently exist. The Planner suggested, <br />however, that City staff would have to do additional research on whether <br />Figg was established legally. <br />Duray recommended approval of a Conditional Use Permit allowing proof <br />of parking at 38 West Woodlyn Avenue as requested by R & S Automotive <br />subject to compliance with the recommendations of the City Planner as <br />outlined in his report dated October 3, 2008. <br />Motion seconded by Pechmann. <br />Motion carried 7 - 0. <br />Duray recommended approval of a Conditional Use Permit for outdoor <br />storage of vehicles and waste containers for R & S Automotive at 38 West <br />Woodlyn Avenue subject to compliance with the recommendations of the <br />City Planner as outlined in his report dated October 3, 2008. <br />Motion seconded by Socha. <br />Motion carried 7 - 0. <br />Duray recommended denial of the Variance from the provision that an <br />Interim Use Permit for off-site outdoor storage must be operated by a local <br />business based on the findings of fact outlined in the City Planner's October <br />3, 2008 report that there are no special conditions or circumstances which <br />are not economic in nature that would impair the ability to put the property <br />to reasonable use if the variance is not granted. <br />Motion seconded by Knudsen. <br />Motion carried 7 - 0. <br />Duray recommended approval of Interim Use Permits allowing off-site <br />outdoor storage on the R & S property at 38 West Woodlyn Avenue subject <br />to compliance with all Code requirements, and recommending that the <br />existing outdoor storage tenants be allowed 12 months to vacate the R & S <br />property and fnd another location. <br />Motion seconded by Knudsen. <br />-9- <br />
