CITY OF LITTLE CANADA <br />AN ORDINANCE ESTABLISHING HOUSING IMPROVEMENT AREA NO. 2 PURSUANT TO <br />MINN. STATUTE § 428A.11 THROUGH 428A.21. <br />THE CITY COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />1. FINDINGS AND RECITALS: <br />(A) The City of Little Canada ("City") is authorized under Minnesota Statutes, Sections 428A.1 I to <br />428A.21, to establish by ordinance a housing improvement area within which housing <br />improvements are made or constructed and the costs of the improvements are paid in whole or in <br />part from fees imposed within the area. <br />(B) The Council finds that owners of at least 25 percent of the housing units within the Canabury <br />Townhouses have filed with the City Clerk a petition requesting a public hearing regarding the <br />establishment of a housing improvement area for the condominium property. <br />(C) The Council has determined a need to establish a Housing Improvement Area No. 2 with the <br />following boundaries: <br />All of Blocks I through 11, Canabury Townhouses, according to the plat thereof on file and of <br />record in Ramsey County, <br />in order to facilitate certain improvements to the property known as Canabury Townhouses. <br />Housing Improvement Area No. 1 contains 62 housing units as of the date of adoption of this <br />ordinance. <br />(D) The Council has on November 12, 2008 conducted a public hearing, duly noticed in accordance <br />with Minn. Stat. § 428A.13, regarding adoption of this ordinance at which all persons, including <br />all owners of property within Housing hnprovement Area No. 2, were given an opportunity to be <br />heard. <br />(E) The Council finds that, without establishment of Housing Improvement Area No. 2, the Housing <br />Improvements hereafter defined could not be made by the condominiwn association for, or the <br />housing unit owners in, Canabury Townhouses. <br />(F) The Cowrcil further finds that designation of Housing Improvement Area No. 2 is needed to <br />maintain and preserve the housing units within such area. <br />(G) The City shall implement and administer the Housing Improvement Area created herein <br />2. <br />For the purposes of this ordinance and Housing Improvement Area No. 2, the term "Housing <br />Improvements" shall mean the following improvements to housing units, garages, and common areas <br />within Housing Improvement Area No. 2: <br />Reconstruction of the driveway and parking areas sewing Canabury Townhouses including the <br />installation of curb and gutter, storm water control, and sidewalks incidental to the overall project. <br />
