MINUTES <br />CITY COUNCIL <br />DECEMBER 22, 2008 <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-12-317 -DENYING THE VARIANCE <br />REQUESTED BYR & S AUTOMOTIVE FROM THE PROVISION <br />THAT AN INTERIM USE PERMIT FOR OFF-SITE OUTDOOR <br />STORAGE MUST BE OPERATED BYA LOCAL BUSINESS BASED <br />ON THE FOLLOWING FINDINGS: <br />o THERE IS NO HARDSHIP PRESENT TO WARRANT <br />THE GRANTING OF THIS VARIANCE AS THE <br />PROPERTY IS BEING PUT TO A REASONABLE USE; <br />o THE VARIANCE REQUEST IS ECONOMIC IN <br />NATURE, WHICH IS NOT ANALLOWABLE <br />CRITERL4 FOR GRANTING A VARIANCE; <br />o BASED ON THE FINDINGS IN THE CITY <br />PLANNER'S REPORT DATED OCTOBER 3, 2008; <br />o BASED ON THE TESTIMONY THAT WAS MADE <br />THIS EVENING BY THE PROPERT OWNERS AND <br />THEIR REPRESENTATIVE <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Attorney noted the discussion this evening relative to bringing <br />the R & S property into Code compliance within an 18 or 24 month <br />period, and noted the receipt of a written statement from R & S dated <br />December 18, 2008 that they will relinquish all claims to their salvage <br />operation if granted a 24-month grace period for bringing the property into <br />compliance. <br />It was further noted that given the Variance request from IUP standards <br />was denied, action on the application for an IUP would not be granted. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2008-12-3I8 -DENYING THE REQUEST FOR <br />INTERIM USE PERMITS MADE BY R & S AUTOMOTIVE FOR <br />OFF-SITE OUTDOOR STORAGE FOR SEVERAL BUSINESSESAT <br />THEIR 38 WOODLYNAVENUEPROPERTYGIVENDENIAL OF <br />13 <br />
