MINUTES <br />CITY COUNCIL <br />DECEMBER 22, 2008 <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-12-314 -APPROVING A CONCEPT <br />PLANNED UNIT DEVELOPMENT PERMIT ALLOWING THE <br />DEVELOPMENT OFANASSISTED LIVING AND MEMORY CARE <br />COMMUNITY CONSISTING OF A TOTAL OF 52 PRIVATE <br />APARTMENT UNITS AS WELL AS A RETAIL BUILDING AND AN <br />OFFICE/COMMERCL4L BUILDINGAT THE SOUTHEAST <br />CORNER OF RICE STREET AND COUNTRYDRIVE AS <br />REQUESTED BY FICEK INVESTMENT 2 LLC SUBJECT TD <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br />PLANNER OUTLINED IN HIS REPORT DATED DECEMBER 5, <br />2008 AND SUBJECT TO THE RECOMMENDATIONS OF THE CITY <br />ENGINEER AS OUTLINED IN HIS REPORT DATED DECEMBER <br />4, 2008 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />R & S Blesener opened the continuation of Public Hearing on the following <br />AUTOMOTIVE- zoning requests made by R & S Automotive, 38 Woodlyn Avenue: <br />38 WOODLYN Conditional use Permit for outdoor storage of vehicles and <br />AVENUE waste containers; <br />Variance from the provision that an Interim Use Permit for off-site <br />outdoor storage must be operated by a local business; <br />Interim Use Permits allowing off-site outdoor storage for several <br />businesses; <br />Appeal of City Staff's determination the Salvage Yard is not <br />grandfathered in; <br />Conditional Use permit allowing proof of parking. <br />The City Planner noted that the Planning Commission recommended <br />approval of the CUPs for outdoor storage and proof of parking that relate <br />to the R & S Automotive business. They recommended denial of the <br />Variance and IUP related to off-site outdoor storage for non-local <br />businesses, and upheld the City staff's determination that the Salvage <br />Yard is not grandfathered in. <br />The City Planner reported that City staff has met with the applicants <br />relative to their property and have requested that the City allow them a <br />period of time to get the property into compliance. If the City Council is <br />agreeable, the direction would be to inshuct City staff to forego <br />9 <br />
