STAFF REPORT <br />TO:Mayor Keis and Members of the City Council <br />FROM:Heidi Heller, City Clerk/HR Manager <br />DATE:October 12, 2022 <br />RE:Conciliation Court Claim Against PermitWorks, LLC <br />ACTION TO BE CONSIDERED <br />Authorize City Attorney to Sign Statement of Claim for Conciliation Court Claim Against <br />PermitWorks, LLC <br />BACKGROUND <br />In January 2020, the City paid PermitWorks, LLC $11,070 for the purchase of 3 software <br />modules for permits & inspections, business & rental licensing and contractor licensing, along <br />with the support plans for the first year. City staff initially intended to do most of the data input <br />for these modules in order to reduce the set-up costs, but in June 2021, staff requested that <br />PermitWorks staff complete the set-up. PermitWorks staff agreed in June 2021 to complete the <br />software set-up and stated they would charge an hourly fee to do so. City staff had some <br />communications with PermitWorks staff through August 2021, but have had no responses from <br />PermitWorks at all since then, despite many attempts through multiple email addresses and by <br />postal mail, including two letters from the City Attorney. There is no phone number for <br />PermitWorks that accepts voicemail. The software is currently not operational and at this point, <br />we need to move on and find a new software vendor (city staff has begun that process). <br />After two letters were mailed to PermitWorks by the City Attorney, and no response was <br />received, staff has directed the City Attorney to take the next step in efforts to be refunded. The <br />City Attorney will be filing a claim in conciliation court on the City’s behalf, and have requested <br />that the City Council authorize them to sign the statement of claim. <br />RECOMMENDATION <br />Staff recommends authorizing the City Attorney to Sign the Statement of Claim for Conciliation <br />Court Claim Against PermitWorks, LLC
