2 <br /> <br /> <br />8. The parties are authorized and empowered to enter into this Grant Agreement by the Laws <br />of the State of Minnesota. <br /> <br />NOW THEREFORE, in consideration of the promises and mutual covenants and <br />undertakings set forth in this Grant Agreement, the Authority and Grantee agree as follows: <br /> <br />PART 1 <br />GENERAL CONDITIONS <br /> <br /> Section 1.1 Term. This Grant Agreement and activities authorized by it is effective for <br />the fiscal year beginning on July 1, 2022 (“Effective Date”), and will be in force and in effect <br />through June 30, 2023 (“Termination Date”). The Term includes any period of time after the <br />Termination Date that the Grantee has control over CDBG Funds, or property purchased in whole <br />or in part with CDBG Funds, all in accordance with the provisions of this Grant Agreement. This <br />Grant Agreement may be amended by written agreement consented to and signed by both parties. <br /> <br />Section 1.2 Scope of Work or Services. Grantee is required to perform and carry out in <br />a satisfactory and proper manner the work or services set forth in Grantee’s Application. This <br />Grant Agreement may be amended from time to time, in accordance with these General <br />Conditions, for the purpose of adding new projects, amending the scope of work, or for any other <br />lawful purpose. <br /> <br />Section 1.3 Use of CDBG Funds. Grantee agrees to use the CDBG Funds exclusively <br />for the purposes permitted under the Act. Grantee will perform all activities set forth in the <br />Statement of Work/Scope of Services as set forth in Grantee’s Application, and will undertake <br />these activities in accordance with the terms of this Grant Agreement and with any statutory or <br />regulatory provisions governing the CDBG Program, including but not limited to the CDBG <br />Program Entitlement Grant Regulations (24 CFR Part 570), as applicable. Grantee may not use <br />the CDBG Funds for any other purpose, unless Grantee obtains the prior written consent of the <br />Authority. <br /> <br /> Section 1.4 Commencement and Completion of Projects. Upon release of project <br />related funds by HUD pursuant to federal regulations, the Authority will furnish Grantee with <br />written notice to proceed. No work on the project is allowed to occur prior to the notice to proceed <br />without written approval from the Authority. Unless otherwise set forth in this Grant Agreement <br />or any amendment to this Grant Agreement, a project is expected to be substantially completed <br />within 24 months from the date which this Grant Agreement is executed. Projects which do not <br />show substantial progress toward substantial completion within the timespan specified in <br />Grantee’s Application may be terminated at the sole discretion of the Authority, upon 30 days’ <br />written notice to Grantee. <br /> <br /> Section 1.5 Administration. <br /> <br />A. Grantee is required to appoint a liaison person who will be responsible for the overall <br />administration of block grant funded project(s) and coordination with the Authority.
