MINUTES CITY COUNCIL JANUARY 28, 2009 TEMO SUNROOMS CODE COMPLIANCE MARCH MEETING CHANGE The City Administrator reviewed the Code Enforcement Officer's January 22, 2009 report relative to code compliance issues at Temo Sunrooms at 2905 Country Drive. It was noted that after several attempts to achieve code compliance under the PUD Permit, the gazebo has been removed from the property, but the two display trailers remain on the property. The Administrator outlined the options available to the City which include continuing contact with Temo Sunrooms to achieve compliance, issuing citations for the violations, or pursuing revocation of the PUD Permit. It was the consensus of the Council to request that Mr. Maietta, Tema Sunrooms, appear before the Council in February to discuss this non- compliance issue. Should those discussions not prove successful, the Council indicated their willingness to pursue revocation of the PUD Permit. Mr. Keis introduced the following resolution and moved its adoption: RESOLUTIONNO. 2009-1-29 -RESCHEDULING THE MARCH 9, 2009 REGULAR COUNCIL MEETING TO TUESDAY, MARCH 10, 2009 AT 7:30 P.M. The foregoing resolution was duly seconded by Boss. Ayes (4). Nays (1) Montour. Resolution declared adopted. CALL FOR Mr. James Monge III, League of Minnesota Cities attorney representing CLOSED the City in the Valor Enterprises litigation, advised the City Council to SESSION - call for a closed session to discussion settlement discussions and VALOR negotiations pursuant to State Statutes. He noted that there will be no LITIGATION decisions made at this closed session and no other business will be discussed. Mr. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO.2009-1-30 - TEMPORARILYADJOURNING THE REGULAR COUNCIL MEETING AND CONVENING INTO CLOSED SESSION The foregoing resolution was duly seconded by Boss. Ayes (5). Nays (0). Resolution declared adopted.
