NORTHWEST ASSOCIATED CONSULTANTS, INC. <br />4800 Olson Memorial Highway, Suite 202, Golden Valley, MN 55422 <br />Telephone: 763.231.2555 Facsimile: 783.231.2561 plan nersC~nacpla nning.com <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: February 6, 2009 <br />RE: Little Canada - Temo Sunrooms -PUD Permit Revocation <br />FILE NO: 758.09 - 09.07 <br />Background and Analysis <br />In March of 2008,Temo Sunrooms was granted two PUD Permits for outdoor storage. <br />The first related to three display trailers which were to be stored in the rear of the <br />property between April 1 and October 31, with the requirement that the trailers would be <br />off-site from November 1 through March 31 while they were being used at trade shows. <br />This permit was granted for storage during these periods for both 2008 and 2009, after <br />which the City would review the permits and consider (potentially) any extension. <br />The second permit related to a gazebo, also used for display. This gazebo had been <br />approved in 2007 for display during the same period (April through October). In 2008, <br />the applicant sought permission to display the gazebo year-round, a request that was <br />denied by the Council, which reiterated the display period approved in 2007. <br />The applicant has continued to store both the trailers and the gazebo beyond the permit <br />dates, despite significant amounts of correspondence from the Code Enforcement <br />Officer. Although the review period for the trailers was not scheduled until later this year <br />(October), staff is bringing the issue forward at this time since the applicant has refused <br />to comply with the terms of the permit issuance. <br />The City has the following options for enforcement: <br />For the display trailers - <br />a. Revoke the PUD Permit at this time, based on noncompliance with the terms <br />of the permit. <br />b. Allow use of the remainder of the permit through October 2009, but act now to <br />deny any renewal/extension after that date. <br />
