The applicant <br />received PUD Permit amendments in 2007 and 2008, however the improvements in <br />those approvals were not all completed. Moreover, the applicant had been subject to <br />code enforcement issues related to outdoor storage that had not been part of the <br />approvals. <br />A part of the previous approvals included the construction of a garage/storage building <br />at the western edge of the property, replacing the existing garbage enclosure in that <br />location. The applicant had, at the time, been storing materials in the garbage <br />enclosure, and storing dumpsters outside in the parking area. <br />The applicant has been working with City staff to clean up the code violations over the <br />past several months. The current request is to provide a new garbage enclosure <br />attached to the building, leaving the current structure available for storage, with the <br />understanding that it would eventually be replaced by the larger garage building that <br />was previously approved, but not yet built. <br />The proposed enclosure measures nine feet by 10 feet, constructed of concrete block, <br />with a gate that would open to the parking/drive access to the west. The principal <br />building is 21.3 feet from the north property line. Construction of the enclosure as <br />proposed would result in a side setback of between 11 and 12 feet, depending upon the <br />orientation of the enclosure. <br />The property is zoned PUD, and the City has typically applied I-P, Industrial Park zoning <br />standards to the buildings in this area. In that zoning district, the side yard setback is 15 <br />feet. As such, the current proposal is seeking flexibility under the PUD to allow a lesser <br />
