STAFF REPORT <br />TO:Planning Commission <br />FROM:Corrin Wendell, Community Development Director <br />Brian Reimers, Administration Fellow <br />DATE:August 7, 2023 <br />RE:City Code Chicken and Fowl Ordinance Discussion <br />ACTIONS TO BE CONSIDERED <br />The Planning Commission is asked to discuss the options with the intent on the adoption of <br />allowing chickens and fowl in the City Code and Ordinance. <br />BACKGROUND <br />At the January 25, 2017 City Council meeting, a group of residents approached the City Council <br />and asked that the discussion to allow chickens be revisited by the City. This group had been <br />working with Councilmember Torkelson, and have done quite a bit of community outreach on <br />this topic. The Council chose to hold a workshop and invite the community members to present <br />their information and request to the Council and have another discussion on this topic. <br />Since the denial of the adoption of chickens and fowl to the ordinance back in 2017, there have <br />been more recent discussions from residents to Mayor and Councilmembers and from <br />Councilmember Guitierrez to City Staff in updating City Code to allow chickens and fowl to be <br />kept on resident’s property. With this discussion, the City has gathered information from <br />surrounding municipalities on chicken and fowl ordinance, which will be presented. <br />FINDINGS <br />The current City Code in question of updating is 1103.020 where it states “…unlawful for any <br />person to keep, raise, breed, or feed poultry and/or pigeons within the City”. After conducting <br />research against six surrounding municipalities (New Brighton, Mounds View, Shoreview, Arden <br />Hills, Roseville, and Maplewood), all allowing the raising and keeping of chickens and or fowl. <br />There is only one municipality that does not require a license or permit, however, the rest do. <br />The proposed City Code update will allow residents zoned in R-1 and single-family residential <br />may be permitted to keep and raise up to a maximum combined total of four (4) chickens and/or <br />fowl under restrictions: <br />a.Residents must submit for an application <br />b.Coops shall follow accessory building restrictions outlined in Sec. 301 of City Code <br />c.Coops shall be maintained in a clean and sanitary manner <br />d.Chickens and or fowl will be kept in the backyard, which will be fenced in <br />e.Rooster, drakes and the butchering of animals on property will be prohibited
