A-1 <br /> <br /> <br />MEMORANDUM OF UNDERSTANDING FOR THE <br /> <br />PIONEER PARK STORMWATER REUSE SYSTEM BETWEEN <br /> <br />RAMSEY-WASHINGTON METRO WATERSHED DISTRICT <br /> <br />AND <br /> <br />CITY OF LITTLE CANADA <br /> <br /> <br />This joint powers agreement (the “Agreement”) is entered into this _____ day of <br />_______________, 2023 by and between the Ramsey-Washington Metro Watershed District <br />(“RWMWD”), a watershed district under the laws of Minnesota and City of Little Canada (“Little <br />Canada”), a municipal corporation. <br /> <br /> WHEREAS, Pioneer Park is located in and maintained by Little Canada; and <br /> <br /> WHEREAS, Little Canada owns park property located at 2950 Centerville Road <br />specifically an area west of Desoto Street and Costa Lane attached hereto (Exhibit A); and <br /> <br /> WHEREAS, RWMWD has funds available to design and implement a stormwater-reuse <br />irrigation system in Pioneer Park to conserve groundwater and reduce phosphorus loading to <br />downstream district waterbodies including Gervais Creek and ultimately Gervais Lake (the <br />“Project”); and <br /> <br /> WHEREAS, RWMWD and Little Canada wish to enter into this Agreement for the purpose <br />of specifying their respective obligations and responsibilities in implementing the design and <br />construction of the Project. <br /> <br /> NOW, THEREFORE, in consideration of the mutual undertakings herein expressed, the <br />parties agree as follows: <br /> <br />1. Purpose. The purpose of this MOU is to specify the duties of the parties as they <br />implement the design and construction of the Project. It is also intended to address <br />the responsibilities of the parties for the long-term operation and maintenance of <br />the facilities and improvements to be constructed under the Project. <br /> <br />2. Description of Project. The Project will be constructed on the property under City <br />parkland in an existing turf grass area on the east side of the park to the west of <br />Desoto Street. The Project will collect water from an existing stormwater pond and <br />wetland to use for irrigation on 11.2 acres of parkland. These basins collect runoff <br />from Pioneer Park. A general depiction of the Project is included on Exhibit B <br />attached hereto.
