MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 2023 <br />when reviewing the cities surveyed. She noted that the fees and duration was also acceptable to the <br />Planning Commission and residents that provided input. Mayor Fischer commented that he would <br />want the fee to cover the staff time needed to process applications and code enforcement. The <br />Community Development Director commented that they would track licenses in a similar fashion to <br />rental licensing. She stated that they will also track nuisances and code enforcement. <br />Kwapick stated that he likes the requirement for a site plan and coop specifications. He asked if an <br />educational component was considered. He noted that another community requires a two-hour video <br />to be watched on the best practices for keeping chickens. The Community Development Director <br />stated that education was discussed at the Planning Commission meeting and in addition to the <br />application, they would provide an educational handout and links to educational programs/courses <br />available. She stated that the City could also offer a chicken keeping offering to its recreational <br />programing. Kwapick stated that he was not as interested in offering a program but passing on <br />educational information or links to things that are already out there. Mayor Fischer commented that it <br />would seem to make sense to have a link to educational information next to the application or on the <br />website. <br />D. Miller commented that this is not a cheap endeavor and most people deciding to keep chickens are <br />looking up that information. He agreed that they should still include links to educational information. <br />He asked what would happen if someone does not renew their application and has the coop but no <br />longer has chickens. The Community Development Director replied that they would want to ensure <br />that it does not become trash in the yard. She stated that if the structure were not deteriorating it could <br />be considered similar to a bench or gazebo in the yard. <br />Kwapick asked and received confirmation that the license would apply to the address. <br />Mayor Fischer asked what would happen if someone continues to have chickens but does not renew <br />their application. The Community Development Director replied that letters would be sent out in <br />reminder of the expiration of the license. She stated that if no response is provided, code enforcement <br />would visit the property and attempt to make contact. She stated that if there is still no response, they <br />would follow the typical code enforcement process that could involve fines. <br />T. Miller commented that she would have concern with neighbors if there is a five-foot setback. She <br />stated that some people do not want chickens near their property and five feet is not that much space in <br />a side yard. She commented that she would prefer to see them in the backyard. The Community <br />Development Director commented that in some cases there would not be enough space in the side yard <br />for the coop to be located. She confirmed that concerns were received from residents that have <br />features in their backyard that would be concerned with chickens nearby. She commented that there <br />are some pie shaped yards that have much more space to allow a coop and therefore those parcels <br />would make sense. Mayor Fischer commented that the rear yard is preferred but the side yard was <br />added to address more unique properties. He noted that the site plan review would allow staff to <br />discuss the most appropriate placement. <br />T. Miller asked if there would be a notification for neighbors.
