Setback from shorelands: <br />Within the Zoning Ordinance, Chapter 910, Shoreland Overlay District, the City requires that <br />structures are setback from the OHW (Ordinary High Water) line for Recreational Development, <br />General Development water bodies, and Tributary River Segments at 75 feet, 50 feet, and 30 feet <br />respectively. For example, Gervais Lake is a Recreational Development body of water. The DNR <br />does not have rules related to chickens specifically and the placement to adjacent bodies of water, <br />however the City Council can require a setback if desired. The MPCA does have rules related to <br />poultry waste in proximity to waterways and runoff, but it is enacted for large farms and substantial <br />waste and not individual chicken coop structures for hobby farm use. <br />RECOMMENDED ACTION <br />Adopt Ordinance 881, amending City Code Chapter 1103.020 and enacting City Code Chapter <br />1103.030: the Raising of Chickens within the City, and approve publication of a summary <br />ordinance. <br />Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary <br />may be published.
