Setback from shorelands:
Within the Zoning Ordinance, Chapter 910, Shoreland Overlay District, the City requires that
structures are setback from the OHW (Ordinary High Water) line for Recreational Development,
General Development water bodies, and Tributary River Segments at 75 feet, 50 feet, and 30 feet
respectively. For example, Gervais Lake is a Recreational Development body of water. The DNR
does not have rules related to chickens specifically and the placement to adjacent bodies of water,
however the City Council can require a setback if desired. The MPCA does have rules related to
poultry waste in proximity to waterways and runoff, but it is enacted for large farms and substantial
waste and not individual chicken coop structures for hobby farm use.
RECOMMENDED ACTION
Adopt Ordinance 881, amending City Code Chapter 1103.020 and enacting City Code Chapter
1103.030: the Raising of Chickens within the City, and approve publication of a summary
ordinance.
Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary
may be published.
