1 <br /> <br />City of Little Canada Personnel Policy <br /> SECTION 10 - OVERTIME & COMPENSATORY TIME <br /> <br />City Administrator, Park & Recreation/Community Services Director, Public Works Director, Building <br />Official, City Clerk/HR Manager, Finance Director, Community Development Director and <br />Community Relations Manager - These employees are paid on an annual salary basis, therefore, <br />exempt from both overtime and compensatory time requirements. <br /> <br />Public Works & Parks Maintenance Regular Employees - All such employees shall be entitled to pay at <br />the rate of time and one-half for all hours worked in excess of eight (8) hours per work day. <br />Employees are required to have the prior approval of their supervisor in order to work overtime. <br />Compensatory Time (Comp Time) and Paid Time Off (PTO)/Earned Sick and Safe Time (ESST) <br />cannot be combined with “hours worked” in determining eligibility for overtime pay and/or <br />compensatory time. In lieu of overtime pay, the employee may elect compensatory time off at the rate <br />of one and one-half hour compensatory time for each hour worked in excess of eight (8) hours per <br />work day. Any time worked in excess of eight (8) hours per day shall be recorded on the employee’s <br />timesheet. <br /> <br />All other Regular Non-Exempt Employees – All such employees shall be entitled to pay at the rate of <br />time and one-half for all hours worked in excess of forty (40) hours per work week. Employees are <br />required to have the prior approval of their supervisory in order to work overtime. Compensatory Time <br />(Comp Time) and Paid Time Off (PTO)/Earned Sick and Safe Time (ESST) cannot be combined with <br />“hours worked” in determining eligibility for overtime pay and/or compensatory time. In lieu of <br />overtime pay, the employee may elect compensatory time off at the rate of one and one-half hour <br />compensatory time for each hour worked in excess of forty (40) hours per work week. Any time <br />worked in excess of forty (40) hours per week shall be recorded on the employee’s timesheet. <br /> <br />In the case of an employee who requests to work less than their normal 8-hour work schedule on a <br />given day due to personal needs, and upon approval by the supervisor, that employee may be allowed <br />to make up the time during the same 40-hour work week (Wednesday through Tuesday) at straight <br />time. Example, employee works 7 ½ hours on Monday, can make up the half hour the next day, thus <br />working 8 ½ hours on Tuesday. This 8 ½ hours is paid at straight time and overtime or comp time <br />would not be generated. If the time cannot be made up during the same work week, the employee will <br />be required to use PTO/ESST and/or comp time to make up their time. <br /> <br />Use of compensatory time shall in all cases be subject to the needs of the department and prior <br />approval of the employee's supervisor. It shall be the duty of the employee to provide an accurate <br />accounting of compensatory time on their timesheet during each pay period. <br /> <br />Compensatory time may be accrued to a maximum of forty (40) hours. Each supervisor is responsible <br />for monitoring their employees accounting of all such hours worked, and number of hours accrued. <br />Accrual of Comp Time in excess of forty (40) hours must be approved by the City Administrator. <br /> <br />Temporary or Seasonal Employees – All such employees shall be entitled to pay at the rate of time and <br />one-half for all hours worked in excess of forty (40) hours per work week. Parks and Public Works <br />seasonal workers are paid a shift differential for any hours worked outside the regular workday. The <br />regular workday is Monday through Friday, 6:00 a.m. to 5:00 p.m. Saturdays, Sundays, holidays and <br />weekday hours before 6:00 a.m. or after 5:00 p.m. are defined as other than the normal workday. The <br />shift differential amount is established in the salary schedule.
