15 <br /> <br />City of Little Canada Personnel Policy <br />SECTION 21 - NON-DISCIPLINARY SEPARATION <br /> <br />Resignation <br /> <br />A. Any employee wishing to leave the City service in good standing shall file with his supervisor <br />at least fourteen (14) calendar days before leaving a written resignation stating the effective date <br />of this resignation. Failure to comply with this procedure may be considered cause for denying <br />such employee future employment by the City. <br /> <br />B. Unauthorized absence from work for a period of three (3) days may be considered by the <br />supervisor as a resignation. <br /> <br />Severance Pay <br /> <br />All regular full-time and part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for unused Paid Time Off (PTO)/Earned Sick and Safe Time <br />(ESST), sick time and compensatory time subject to maximum accruals. Employees leaving the City’s <br />employ can elect to be compensated for unused accrued PTO/ESST or to have the value of accrued <br />PTO/ESST deposited in the employee’s Post Employment Health Care Savings Plan subject to election <br />requirements of the Plan. <br /> <br />All regular full-time and regular part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for remaining deferred sick leave balances based on the schedule <br />below. Severance pay based on deferred sick leave will only be paid by the City to the employee’s Post <br />Employment Health Care Savings Plan. For those employees that opted to convert deferred sick leave <br />to PTO as provided for in the PTO/ESST provision of this policy, the time converted will be deducted <br />from the pay-out maximums below on a one-for-one basis. <br /> <br /> % of Unused Sick To Pay-Out <br /> Leave Balance Maximum <br /> 5 years to less than 10 years of service 30% 10 days (80 hours) <br /> 10 years to less than 15 years of service 35% 20 days (120 hours) <br /> 15 years to less than 20 years of service 40% 30 days (240 hours) <br /> 20 years of service and above 50% 42 days (336 hours) <br /> <br />All regular full-time and regular part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for 50% of the remaining sick leave balance, up to a maximum of <br />500 hours. Severance pay based on sick leave will be paid by the City to the employee’s Post <br />Employment Health Care Savings Plan, 457b retirement account, cash payout, or a combination of the <br />three options. <br /> <br />ESST hours will not be paid out at separation. If the employee returns to work at the City within 180 <br />days, their previously accrued ESST hour balance will be reinstated. <br /> <br />Lay-Offs <br />A. The City Administrator, with approval by the City Council, may lay-off any regular full-time or <br />regular part-time employee whenever such action is made necessary as provided in the annual <br />budget by reason of shortage of work or funds, the abolition of a position or because of changes
