<br />2 <br /> <br />Staff worked with Xcel Energy over the winter of 2023-2024 to obtain the proper agreement so the <br />trail extension could be possible. The proposed license agreement is very much in line with typical <br />license agreements of this nature. <br /> <br />One item of note on the agreement is the city shall maintain general liability insurance on the <br />Licensed Property with a single limit protection of at least One Million Dollars ($1,000,000) with <br />respect to personal injury or death and property damage occurring or resulting from one occurrence. <br />Staff can provide a certificate of insurance (COI) to Xcel Energy at no cost to the city. <br /> <br /> <br /> <br />TRANSFER OF PROPERTY <br />If the Council approves the license agreement and the new section of trail is constructed, the entire <br />trail (east-west) will go through seventeen different parcels. Many of the parcels are city-owned, or <br />the city has an easement on the parcel for a trail. Xcel Energy has indicated they would like to <br />transfer the Licensed Property to the city on the remaining five parcels that they own. Since the <br />transfer of property can take months to review and complete, staff has been working with Xcel <br />Energy for the attached license agreement so the trail can be constructed without delays. Information <br />on the property transfer will be given to the Council in the future. <br />
