<br />2 <br /> <br /> <br />(b) The grant of Licensee under Paragraph 1 herein shall extend to, including, but not <br />limited to, its invitees, employees, licensees, agents, independent contractors, <br />subcontractors and suppliers (collectively the “Access Parties”). <br /> <br />(c) Licensee shall ensure all of the Licensed Property is kept free of rubbish, waste, <br />debris and Licensed Property is kept in a neat, safe and orderly condition. <br /> <br /> <br /> <br />(d) Licensee shall ensure that the Licensed Property and the surrounding areas will be <br />returned to NSP in a clean and respectable condition prior to the expiration of the <br />Agreement. <br /> <br />(e) Any soil disturbance created by Licensee shall be graded, seeded and mulched to <br />prevent soil erosion. <br /> <br />(f) The Licensed Property shall not be used in any manner or form inconsistent with <br />the allowed use of the Licensed Property stated herein. <br /> <br />(g) Licensee shall ensure that there shall be no fires or open burning on the Licensed <br />Property, including but not limited to bonfires, campfires, fireworks, cooking fires, <br />torch burning and open flames. <br /> <br />(h) Licensee shall ensure that there will not be any references that will defame or <br />present NSP in a negative or harmful way. <br /> <br />(i) NSP shall have the right to pre-approve the exact location(s) of the Permitted Use, <br />reserving the right to make modification to those location(s) when deemed <br />necessary. <br /> <br />(j) There shall be no new vegetation planted without Xcel Energy’s written approval. <br /> <br />(j) <br />(k) There shall be no additional permanent or temporary buildings allowed within the <br />property limits, without prior written approval from Xcel Energy. <br /> <br />(l) If there are to be streetlights, signboards, identification signs or any other type of <br />non-building structure within the easement, detailed plans must be submitted to <br />Xcel Energy prior to construction for review and approval to verify compliance <br />with electrical code clearances prior to construction start. <br /> <br />Metallic structures must be properly grounded. The same working clearance <br />criteria as stated in paragraph (4) also applies, for equipment used to erect and <br />install light standards, sign boards, etc. Any metallic structure, pole, wire or item <br />placed in the vicinity of a high-voltage transmission line will have the potential to
