MINUTES <br />CITY COUNCIL <br />MAY 27, 2009 <br />ST. JUDE staff has experienced some near rear-end accidents due to the slowing <br />MEDICAL down in the eastbound lane to make the turn. The Engineer indicated that <br />there is insufficient right-of=way to add the turn lane, however, St. Jude <br />Medical will grant the additional right-of way. St. Jude will also pay the <br />cost of the turn lane installation, but asked that the City look at <br />reimbursing this cost through Tax Increment Financing if there are the <br />funds available. <br />'T'here was some discussion about left turns into the St. Jude property, with <br />the Engineer indicating that St. Jude is requesting that the west radius of <br />the westerly most entrance be increased for easier access to the site. This <br />will allow for the corner to be taken at a slightly higher speed from the <br />eastbound lane on County Road B-2. <br />The City Engineer stated that based on his review of the existing <br />conditions, he would recommend that the turn lane and driveway radius <br />modification be granted. The estimated total project cost is between <br />$20,000 and $25,000. The Engineer also recommended that it be handled <br />as a change-order to the 2009 Improvement work. That change order will <br />be brought back to the Council for approval. <br />The City Administrator reported that reimbursement of these costs would <br />be eligible under TIF and stated that there may be excess TIF funds fi•om <br />the second phase. If so, a TIP note would be entered into to provide the <br />reimbursement. The Administrator indicated that he would work with <br />Ehlers Associates on this issue. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-5-777-AUTHORIZING THE CITY <br />ENGINEER TO PROCEED WITH PROJECT DESIGN AND <br />CONSTRUCTION OFARIGHT-TURN LANE AND RADIUS <br />MODIFICATION AS OUTLINED IN HIS MAY 22, 2009 REPORT, <br />AND INDICATING THAT THE CITY WOULD SUPPORT THE <br />REIMBURSEMENT OF COSTS TO ST. JUDE MEDICAL <br />PROVIDED THERE ARE EXCESS TIF FUNDS TO SUPPORT THIS <br />REIMBURSEMENT WITH THE UNDERSTANDING THAT ST. <br />JUDE FUNDS THIS MODIFICATIONAT THIS TIME <br />The foregoing resolution was duly seconded by McUraw. <br />Ayes (4). <br />Nays (0).
