MINUTES <br />CITY COUNCIL <br />MAY 27, 2009 <br />DRIVE not allow for milling of the edges without breakup of the pavement <br />IMPROVEMENTS that is to remain in place. Ifjust the mill and overlay were done, it was the <br />Engineer's position that significant reflective cracking would occur within <br />only a few years. Therefore, the Engineer recommended the removal of <br />the entire bituminous surface and repaving of both bituminous lifts. This <br />would allow for a consistent final product and a longer improvement life. <br />The Engineer reported that the cost to property owners would still be <br />below that which was originally estimated prior to bids being awarded. <br />With the modification, the Engineer estimated the cost at $18.00 to $18.50 <br />per foot, which is about 24% to 25% less than the original estimate. <br />The City Administrator reported that the City Attorney has indicated that <br />the project modification can proceed and the City's process under Statute <br />429 would stand. The increased cost under unit pricing is within the <br />allowable range to amend the contract. The Administrator reported that a <br />letter will be sent to property owners informing them of the change and <br />why it is being made. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-5-118 -AUTHORIZING THE CITY <br />ENGINEER TO PROCEED WITH THE WESTWIND/WINDROW <br />PROJECT AMENDMENT AS RECOMMENDED WITH A CHANGE <br />ORDER TO BE PRESENTED TO THE COUNCIL AT A LATER <br />DATE, AND INSTRUCTING CITY STAFF TO SEND THE <br />APPROPRIATE NOTICE TO IMPACTED PROPERTY OWNERS <br />'fhe foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />TIF The City Administrator reported that as a continuation of the City's <br />DISTRICT assistance with the purchase of 2966 Arcade Street by Masterpiece <br />6-1- Homes, a tax increment financing district needs to be established for <br />2966 this area. The Building Official has completed his inspection of the <br />ARCADE property and structures, and based on these inspections, the property <br />STREET would qualify as a "redevelopment district". This type of district has the <br /> possibility of 25 years of tax increment collections to offset any <br /> development costs beyond those supported by normal market conditions. <br /> "fhe Administrator noted that if for some unforeseen reason costs are not <br /> recovered by market pricing, TIF will keep the City's taxpayers whole. <br /> The Administrator reported that Ehlers & Associates will be putting the <br /> TIP Plan together. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />
