MINUTES <br />PLANNING COMMISSION <br />JUNE 11, 2009 <br />cuts, and recommending approval of the two monument signs on the <br />Culver's property (one for Culver's and one for Lot 2) as requested with <br />the condition that an additional monument sign on Lot 2 would not be <br />allowed. <br />Motion seconded by I)uray. <br />Motion carried 7 - 0. <br />VARIANCE Afroz and Shaz Khan appeared before the Commission requesting <br />2837/2849 approval of a Variance to exceed the maximum fence height allowed in <br />CENTEI2VILLE in a front yard. Shaz Khan reported that the fence is located between <br />ROAD - 2837 and 2849 Centerville Road and is 18 % feet from the curb line of <br />KHAN Centerville Road. He reported that he no longer lives at the property, but <br /> is here this evening to represent his mother, Afroz Khan. <br />Shaz Khan reported that the Variance is being requested for security <br />purposes. He noted that initially there was a row of large evergreen trees <br />in the area where the fence is now located. The trees were removed by the <br />neighbor since some were dying and because of sap that was getting onto <br />his cars. Once the trees were removed there was a void in this at•ea. He <br />indicated that the neighbors on either side of their property have no <br />opposition to the fence. <br />Shaz Khan reported that the began construction on the fence and then <br />learned of the need for both a building permit and a variance for the 6-foot <br />height in the front yard. At that time construction was halted, pending <br />receipt of the variance. Shaz Khan noted that the fence will be shorter <br />once completed, as the concrete blocks will be placed into the ground. <br />The fence is 66 feet in length, will be 6 feet in height and is 18 '/z feet fi•om <br />the Centerville Road curb line. <br />Shaz Khan noted the correspondence that was sent in explaining the need <br />for the fence from a secw•ity standpoint. Shaz Khan indicated that the <br />fence is a shield acid protection from the demeanor of certain individuals <br />in the neighborhood. He reported that the neighborhood had been <br />peaceful at one time, but over the years there has been an increase in <br />questionable activities around the Montreal Courts apat•tment complex. <br />There have been thefts from theirs and the neighbors' properties, <br />vandalism, and individuals approaching children. <br />Shaz Khan reported that a motion sensor security system is mounted on <br />the fence and needs to be a minimum of 5 '/z feet to be effective. This <br />system had currently been mounted in the pine trees prior to their removal. <br />-g- <br />
