MINUTES <br />CITY COUNCIL <br />JUN)J 10, 2009 <br />Tom Cossack, Gordies Place, appeared before the Council and apologized <br />for the violation that occurred. He reported that this is not the way his <br />business is run, and they would never knowingly serve anyone underaged. <br />Cossack also noted that Gordies' is not a bar that is frequented by younger <br />patrons. <br />Cossack also reported that the employee who served the under aged <br />individual is ahard-working, Little Canada resident who feels very badly <br />about his mistake. He also reported that his employees receive server <br />training. <br />The City Clerk reported that the employee received a citation for the <br />violation, and will be prosecuted. The action before the Council this <br />evening relates to the liquor license holder. <br />Cossack reported on his long experience in the liquor business and the fact <br />that there have been only two violations in all his years in business. <br />Keis noted the significant mandatory fines that are in place for tobacco <br />violations, and felt that liquor violations are of a more serious nature given <br />the consequences of drinking and driving. Keis felt that the City should <br />impose a fine that reflects the serious nature of the offense. Montour <br />agreed, but noted that this has not been a big problem in the City. <br />Montour stated that he did not want to impose fines and then stay them <br />resulting in sending a message to the Sheriff s Department that the City <br />does not take this issue seriously. <br />McGraw stated that he understands the nature of the business, but pointed <br />out society's concern with serving liquor to underaged individuals. <br />McGraw agreed that the City needs to send a message to the Sheriff's <br />Department that it is serious about the enforcement of Liquor laws. <br />McGraw indicated that the action this evening is to hold the license holder <br />responsible for the actions of his employee. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-6-724 - IMPOSING A $7, 000 FINE TO <br />GORDIES' PLACE FOR THE APRIL 30, 2009 LIQUOR VIOLATION, <br />STAYING $500 OF THAT FINE IF THERE ARE NO ADDITIONAL <br />VIOLATIONS WITHIN ONE YEAR <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />
