Hanson <br />Carl Costanzo and Mary Fasching have applied for an amendment to their existing Planned Unit <br />Development (PUD) permit to allow additional outdoor storage in the side and rear yard of 3151 <br />Country Drive. A Conditional Use Permit (CUP) was issued in January 2000 for this property to <br />allow outdoor storage along the north side yard of the property. This permit should have <br />originally been called a PUD Permit given the PUD zoning of the property. Going forward to be <br />consistent with this zoning district, city staff will be calling it a PUD Permit. This change in <br />permit name does not change any prior approvals or imply approval of the current amendment. <br />The property owner has non-conforming outdoor storage in various other areas of the property <br />and that is their reason for seeking the amendment. <br />This property is a corner lot located on a 1.01 acre parcel on the northwest corner of County <br />Drive and Ryan Drive. The property is zoned Planned Unit Development (PUD) with an <br />underlying industrial use. The standards from the I-1, Light Industrial are being used for this <br />parcel to be consistent with the zoning of the neighboring parcels. The past approval for this <br />parcel considered Ryan Drive to be the front yard of the lot. By definition under current city <br />code, Country Drive would actually be the front yal•d of the parcel. To be consistent with the <br />treatment of other parcels along Ryan Drive and how this parcel was treated in the past, city staff <br />is using Ryan Drive as the front yard. By doing so, this allows more flexibility to the property <br />owners on their outdoor storage location. I would like to note that with either scenario, storage <br />would not be allowed in front of the front building line (i.e, storage would not be allowed along <br />Ryan Drive). The use of Ryan Drive as the front yard allows the property owner to have storage <br />along both sides of their principal building. If Country Drive had been used with the principal <br />building location setback so far into that northwest corner essential no storage would be allowed <br />because storage cannot occur in front of the front building line of the principal building. <br />City staff has been working with this property owner since May 2007 to get this site into <br />compliance. The City has issued several citations for maintaining a pubic nuisance and violating <br />permit conditions over the past two years. Several meetings, inspections, and letters have taken <br />place with both property owners detailing for them the violations that exist. Over this time, the <br />property owners have continued to promise they will bring the site into compliance or seek an <br />
