This application was made by the applicants the day they were to appear in court <br />for the jury trial on a couple of our citations. <br />In reviewing the application city staff feels there are two options for proceeding with this <br />property - <br />I) Denial of the entire application based on the amended application does not comply with <br />current code requirements. The main objective of the amendment is to allow additional storage <br />along Ryan Drive and all of that additional storage extends past the front building line. Given <br />the recent revisions to the I-1 zoning code, this is not consistent with the intent of the ordinance <br />requirements. In this case, staff would than require the parcel be brought into compliance with <br />their current PUD permit within 90 days. If at the end of the 90 days this site is not in <br />compliance, city staff will recommend we proceed with processing the revocation of the PUD <br />permit. The following are current violations - <br />Vision Tree Services and Minnesota Asphalt are not approved for outdoor storage. <br />Minnesota Asphalt does have office space within the principal building, but Vision <br />Tree Services does not. Under the original PUD permit the outdoor storage was <br />specific to allow for roofing equipment and materials, plus elech•ical supplies. <br />e Outdoor storage is limited to both sides along the principal building and accessory <br />building. No storage can occur past the front line of either building. <br />Wood screening has not been installed. <br />Service doors have not been installed on the accessory building to screen the storage <br />inside. <br />e The 24 required parking spaces have not been established (curbing, paving, and <br />striping). <br />Outdoor storage is not being maintained in a neat and orderly fashion. <br />Junk/Debris exists on the site. <br />o Off-Site Parking is occurring on this parcel with employee vehicles from another <br />property owner in Ryan Industrial Park onto the 3151 Country Drive property without <br />a joint use parking permit being issued. <br />m Also subject to Outdoor Storage License effective 7/1/10. <br />2) Recommend denial for portions of the amendment, but have the applicant bring the entire site <br />into compliance with current zoning code standards. The reason for this option is that back in <br />2000 when permits were being issued for properties in the Ryan Industrial Park, the standards <br />were not as detailed as they are now after the City's recent review of the I-1 zoning dish•ict. By <br />approving only portions of the permit, the site does not gain any additional storage and storage is <br />actually held to a more restrictive standard (i.e. height, placement, amount). However, this <br />amendment would allow Minnesota Asphalt to have outdoor storage since they do occupy 50% <br />of the office space inside the principal building and the owner would gain flexibility in terms of <br />what is stored versus limitations for only roofing equipment and materials. <br />If the City proceeds with this option the requirements of the permit are as follows (staff <br />comments inserted as italics): <br />G.
