MINUTES <br />CITY COUNCIL <br />JUNE 22, 2009 <br />RECOMMENDED BY THE CITY ENGINEER BASED ON HIS <br />FINDING TFIAT THE PUBLIC RIGHT-OF-WAY SERVES NO <br />PUBLIC PURPOSE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CULVERS/ The City Administrator reported that based on the Council's approval <br />SHERMAN of zoning actions for Culvers Restaurant, the City/EDA will need to <br />ASSOCIATES execute a serious of documents to consummate the la~ld transaction. <br />CLOSING The Administrator reviewed his report dated June 18, 2008 and noted <br />DOCUMENTS there are still some issues yet to be worked through with Sherman <br />Associates. He recommended a special meeting be called for Thursday, <br />June 25, 8:00 a.m. to act on the closing documents. <br />George Sherman, Sherman Associates, felt that the outstanding issues <br />would be resolved by Thursday morning, and supported the <br />Administrator's request for the special meeting. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2009-6-I90 - CALLING A SPECIAL MEETING <br />FOR THURSDAY, JUNE 25, 2009, AT 8:00 A.M. TO ACT ON THE <br />CULVERS/SHERMANASSOCIATES CLOSING DOCUMENTS AS <br />RECOMMENDED BY THE CITYADMINISTRATOR <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />VARIANCE- Mayor Blesener opened the Public I-Iearing to consider the request of <br />2837/2849 Afroz Khan for a Variance to exceed the maximum fence height allowed <br />CENTERVILLE in a front yard on her property located ati 2837 Centerville Road. It was <br />ROAD- noted that the City Planner and Planning Commission have recommended <br />KHAN approval of the Variance. <br />The City Planner noted that a fence was installed on the Khan property <br />without a building permit. That fence is approximately 66 feet long and 6 <br />feet in height and runs on or close to the shared property line between <br />2837 and 2849 Centerville Road. T'he Planner noted that the Code limits <br />fence height to 6 '/z feet along a side lot line from the rear lot line to a <br />point equaling the front building line of the principal building. A 4 foot <br />high fence can be constructed along a side lot line from the front building <br />line to the required front yard setback (30 feet from the right-of-way line). <br />
