It shall be a violation of this section for any minor to purchase, or <br />attempt to purchase or otherwise obtain, any cannabinoid products or cannabinoid- <br />related devices, and it shall be a violation of this section for any person to purchase or <br />otherwise obtain those items on behalf of a minor. It shall further be a violation for any <br />person to coerce, or attempt to coerce, a minor to illegally purchase or otherwise obtain <br />or use any cannabinoid products or cannabinoid-related devices. This subsection shall <br />not apply to minors lawfully involved in a compliance check. <br />(e) Use of false identification. It shall be a violation of this section for any minor to attempt <br />to disguise their true age by the use of a false form of identification, whether the <br />identification is that of another person or one on which the age of the person has been <br />modified or tampered with to represent an age older than the actual age of the person. <br />(f) Child-resistant packaging of liquid used in electronic delivery devices. It shall be a <br />violation of this section for any licensee to sell any liquid used in electronic delivery <br />devices, whether or not such liquid contains cannabinoid products, that is intended for <br />human consumption and use in an electronic device that is not in child-resistant <br />packaging. <br /> <br />826.70 EXCEPTIONS AND DEFENSES. <br /> <br />(a) Nothing in this section shall prevent the providing of cannabinoid products or <br />cannabinoid-related devices to a minor as part of a lawfully recognized religious, <br />spiritual, or cultural ceremony. It shall be an affirmative defense to the violation of this <br />division for a person to have reasonably relied on proof of age as described by state law. <br />(b) This section does not apply to the sale of any product by a registered medical cannabis <br />manufacturer pursuant to Minn. Stat. §§ 152.22 to 152.37. <br /> <br />826.75 VIOLATIONS, SUSPENSION, REVOCATION, FINES. <br /> <br />(a) Misdemeanor prosecution. Nothing in this section shall prohibit the city from seeking <br />prosecution as a misdemeanor for any alleged violation of this division. <br />(b) Any violation of the city's regulations relating to the issuance of a cannabinoid products <br />license or of any conditions/restrictions attached to the issuance of such license shall be <br />cause for the imposition of an administrative fine, the suspension of the license or the <br />revocation of the license pursuant to the procedures described in city code section <br />802.120. <br />(c) If the violation relates to the sale of cannabinoid products to minors by licensee or <br />licensee's employees, administrative fines, suspensions or revocations shall be imposed <br />as provided in city code section 802.120. <br />(d) A suspension of license or a license revocation pursuant to this section shall be <br />preceded by a hearing before the city council. <br /> <br />826.80 BILLBOARDS. No billboard, as defined in this chapter, shall promote the sale or use <br />of cannabinoid products. <br /> <br />826.90 SEVERABILITY. If any section or provision of this ordinance is held invalid, such <br />invalidity will not affect other sections or provisions that can be given force and effect without the <br />invalidated section or provision.
