Resolution declared adopted. <br />ORDINANCE 898, ZONING CODE AMENDMENTS FOR GARAGES AND DRIVEWAY <br />CURB CUTS <br />The City Clerk stated that earlier this year there were some changes made to the Zoning Code <br />specifically related to garages. She stated that previously a Conditional Use Permit (CUP) was <br />required for garages above 1,000 square feet noting that multiple requests came through with little to <br />no conditions added and therefore the process was simplified by increasing the total allowable square <br />footage of accessory buildings/garages to 1,500 square feet. She noted that there are some limitations <br />to yard coverage and therefore not every lot would qualify for 1,500 square feet. She explained that <br />the 1,500 square feet would be the total of all accessory structures/garages with the maximum size for <br />one building at 1,000 square feet, or the footprint of the primary structure, whichever would be less. <br />She stated that the City has received a request from a property owner that has a larger property and <br />would like to build a 1,500 square foot garage to replace an existing garage. She stated that because of <br />the way the Code is written that property owner would need to request a variance, noting that there is <br />not a hardship, or could build two structures totaling 1,500 square feet. She stated that the Planning <br />Commission discussed this, and their initial concern was the appearance from the street. She noted <br />that it would be rare for someone to have something that is wider than two or three vehicles and would <br />instead tend to be deeper. She noted that the size of the structure would also be limited by the lot size <br />and required setbacks. She stated that the Commission decided to recommend a limitation of the width <br />of the accessory structure/garage of 1.5 times the width of the primary structure on the lot to prevent a <br />garage much wider than the home. She stated that the Commission then recommended increasing the <br />size of the garage to be up to 1,500 square feet with the additional limitation on the width. She stated <br />that the size of the garage/accessory structure could be higher than 1,500 square feet through a CUP <br />and the Commission will be continuing discussion about additional limitations and conditions that <br />should be included in that process. <br />The City Clerk stated that when the Zoning Code was updated a few years ago the curb cut width <br />maximum was reduced from 24 feet to 18 feet. She stated that staff has found that most people are <br />building three -car garages, and 18 feet is even less than a two -car garage, which has been causing <br />issues with people driving over the grass, and it then becomes dirt. She stated that staff recommended <br />going back to 24 feet for consistency with previous regulations and many existing driveways. She <br />stated that the Planning Commission recommended approval of that change. She stated that the <br />Council is asked to hold a public hearing to consider these changes to the Zoning Code. Staff <br />recommends approval of the changes as presented. <br />0 <br />
