league of minnesota cities
March 16, 1978
Mr. Joseph Chlebech
City Clerk
515 Little Canada Road
Little Canada, Minnesota 55117
Dear Mr. Chlebeck:
I hope you have received the statutes you requested along with the material
on contributions to historical societies.
Still left to answer is your question on PERA. The situation in Little
Canada is that you have a part-time employee employed full time by another
governmental unit. The PERA office has told you that, for this part-time
job, Little Canada must make PERA payments even if this is already done
with his full-time job.
As best I understand the PERA laws, what the PERA office told you is cor-
rect. PERA deductions are determined on the basis of an i ndi vi dual' s total
earnings, provided those total earnings exceed $250 per month. The PERA
law speaks in terms of the "employee" and not the position.. .
I spoke briefly to Merwyn Peterson, Special Assistant Attorney General for
PERA, and he verified that this interpretation is consistent with his
thinking and with the policy of the PERA office.
In case you'd like to discuss this further with the PERA office, Mr. Peterson's
number is ,296-7490. Another person who might be helpful is Arlyn Enstad
also at PERA - 296-7459.
I hope this will be of some help.
Sincerely,
William Makela,
Research Analyst
WM:1 j
f
CLERK'S EXHIBIT NO. 79
Meeting-4-12-78
300 hanover building, 480 cedar street, saint paul, minnesota 55101 (612) 222-2861
