EIGHTH RIDER TO AGREEMENT THIS AGREEMENT, Made this day of , 1978, by and between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, hereinafter called the Board, and the CITY OF LITTLE CANADA, County of Ramsey, Minnesota, hereinafter called the City, being an Eighth Rider to that certain Agreement made by and between said Board and said City the 13th day of July, 1966, and by this reference incorpor- ated herein and made part hereof with the same intent, purpose and effect as if said Agreement were set forth herein, verbatim. WITNESSETH: WHEREAS, The Board is fee owner of a 160 foot wide right-of-way across the North One-half (N15) of Section Eighteen (18) , Township 29 North, Range 22 West, County of Ramsey; and WHEREAS, The City desires permission to enter upon certain portions of said premises and to therein, thereon and thereunder install, and operate a 24-inch water lft�main; and WHEREAS, The Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board, NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agree - meets of the parties hereto, that said Board hereby grants to said City the permission to install and operate a 24-inch water main along and across the Board's right-of-way, as outlined in red color and location as shown on attached drawing marked Exhibit "A". BE IT FURTHER AGREED, That paragraph 42 of the original Agreement dated 13 day of July, 1966, pertaining to "Minimum Standards for Public Waterworks and Public Sewers" be rescinded for this project and that-, the 24-inch water main and appurtenances installa- tion shall be in accordance with the Milner W. Carley & Associates Plan and Specifica- tion for Water main Improvement 77-5, 6 City of Little Canada, dated February 1, 1978, ,.,of said Project, which plan and specifications have been approved by the Board, and CLERK'S EXHIBIT NO. 63 Mee ti ng-4-12-78
