809-6 <br />waste or recyclable materials upon any street, alley, drive, park, playground, or other public <br />place, or upon any privately-owned lot in the City. <br />809.120. BURYING AND BURNING OF DEBRIS, WASTE, AND RECYCLABLES. <br />No person shall bury or burn in the City any debris, waste or recyclables as defined in Section <br />809.020 of this ordinance. The only burning allowed in the City is pursuant to Section 1401 of <br />this Municipal Code. <br />809.130.CONTAINERS. Every property owner, occupant or owner of any dwelling <br />unit or place of business shall control the accumulation of refuse on the premises so as to keep <br />the premises in a clean and sanitary condition. All garbage and rubbish accumulating between <br />the times of collection shall be placed in containers as described below. <br />(A)Specifications. <br />(1)Every property owner or occupant or any place of business that <br />accumulates mixed municipal solid waste shall provide one or more rust resistant, watertight, <br />nonabsorbent and easily washable containers, which are equipped with a bail or handle and <br />covered with close-fitting lid. Containers shall have a capacity of not less than ten (10) nor more <br />than ninety (90) gallons and shall be of sufficient number to store all mixed municipal solid <br />waste and other items accumulating between collections. Places of business having <br />accumulations in excess of three (3) thirty (30) gallon containers per week shall provide vats for <br />storage. Vats shall be no less than one cubic yard capacity, designed with proper attachments for <br />lifting into collection vehicles. <br />(2)Every property owner and occupant of any dwelling unit, including single <br />family homes, duplexes, tri-plexes, four-plexes, low, medium, and high density, mobile <br />manufactured homes, town houses, condominiums and apartment buildings, shall provide a <br />sufficient number of containers, as described above, which do not exceed ninety (90) gallons <br />capacity. An exception to this provision would be possible in the case of multi-family dwelling <br />units where an alternative refuse management plan is submitted to and accepted by the City. The <br />only other exception allowed shall be residents who qualify for the City's organized collection <br />low volume service rate where stickered bags are acceptable for placement at the curb, and <br />dwelling units (low, medium, and high density), which may use plastic bags for over flow of <br />municipal solid waste. <br /> (3)All containers shall be washed and treated with disinfectant as often as <br />necessary to prevent a nuisance. Any containers which do not meet with the above requirements <br />may be used for the storage of mixed municipal solid waste only with the approval of the Public <br />Works Director. <br />(B)Location. <br />(1)At residential dwelling units, containers for garbage, rubbish, recyclable <br />materials, leaves and lawn clippings shall be placed on the curb no more than twelve (12) hours
