STAFF REPORT <br />TO:Chair Johnson and Members of the Planning Commission <br />FROM:Corrin Wendell, AICP, Community Development Director <br />DATE:February 8, 2024 <br />RE:Text Amendment – Amending City Code Chapter 809 – Solid Waste and Recycling <br />ACTIONS TO BE CONSIDERED <br />To recommend approval of a Text Amendment to Amend City Code Chapter 809 – Mixed <br />Municipal Solid Waste and Recyclable Materials Storage and Collection. <br />BACKGROUND <br />The City is bringing forward changes for a proposed text amendment for City Code Chapter 809, <br />specifically addressing modifications to accommodate new zoning district categories for <br />residential use. Additionally, the amendment introduces an opt-in provision for townhome <br />developments, ensuring consistency with waste management guidelines and addressing the <br />evolving needs of our community. City Code Chapter 809 outlines regulations for the storage and <br />collection of mixed municipal solid waste and recyclable materials. Given recent changes in <br />zoning district categories for residential developments, there is a need to update the existing text <br />to maintain relevance and effectiveness in waste management practices. <br />Objectives: <br />The primary objectives of this proposed text amendment are: <br />1.Zoning District Categories: Incorporate language in Chapter 809 to align with new <br />residential zoning district categories, ensuring that waste management regulations are <br />reflective of the evolving urban landscape. <br />2.Opt-In Provision for Townhome Developments: Introduce an opt-in provision <br />specifically for townhome developments. Existing townhome developments will have the <br />option to adhere to the updated regulations voluntarily, while new townhome developments <br />will automatically adopt the revised guidelines. <br />Proposed Changes: <br />1.Inclusion of New Zoning District Categories: The text amendment will include language <br />that accommodates the waste management needs of new residential zoning district <br />categories, outlining specific requirements for each category.
